.rachelmaddow’s gun control “expert” told viewers that all firearms sales must take place at a licensed dealer’s premises. She misrepresented the facts. The Gun Control Act of 1968 permits non-over-the-counter sales, and ATF regulations currently allow such sales if a person has a qualifying permit. For those without a permit, the proposed rule would provide for how a dealer may verify a buyer’s identity and run a point-of-sale background check under the Brady Act. Additionally, the guest said ATF’s rules would “completely wipe out” the background check. Flatly false. Every firearm sale still runs through a licensed in-state dealer. All sales under this rule require a background check. The rule updates how a dealer verifies a buyer’s identity; it does not eliminate the dealer, the check, or the prohibited-person screening.
