There is a lot of noncompliance in the crypto space. It undermines confidence when so many people have been hurt and all they can do is stand in line in the bankruptcy court. Further, this can make it hard for the good faith actors to compete.

Intermediaries for investment contracts are required to comply with securities laws & register with U.S. Securities and Exchange Commission. Instead, many crypto platforms are contending that their investment contracts are something else. The law cares about what something actually is, not what you call it.

There's nothing incompatible in the crypto mkts w/ the securities laws. A goal of our work U.S. Securities and Exchange Commission is to bring this field into compliance. More than 90% of retail investors’ marketable orders are routed to a small group of off-exchange wholesalers. I think retail investors deserve the full benefit of competition. The annual competitive shortfall could be worth ~$1.5B: money that could go into investors’ pockets.
