This time, a group lynching. 熊本でまた凄惨な事件。今度は集団リンチだ。 In the video, the victim is kicked in the head and testicles, punched. If this isn’t attempted murder, then anyone in Japan can do this and be safe from serious prosecution. 動画では、被害者が頭や睾丸を蹴られ、殴られている。これが殺人未遂じゃないなら、日本では誰でもこういうことをしても重い処罰から逃げられる、という空気になってしまう。 The law is aimed at rehabilitation, so it has almost no deterrent power. この制度は更生を目的にしている。だから抑止力がほとんどない。 The law also serves as a sense of security for the perpetrator. そしてこの制度は、加害者にとっての“安心材料”にもなってしまう。 Even if the victim dies, it’s not treated as murder unless intent to kill is proven — it can be treated as “injury resulting in death” instead. たとえ被害者が亡くなっても、殺意が立証できなければ殺人として扱われない。代わりに「傷害致死」として扱われ得る。 So, what’s the issue? では、何が問題なのか？ 1) A system designed around rehabilitation, not deterrence Japan’s Juvenile Act is designed around “healthy upbringing,” “rehabilitation measures,” and “special measures” for juvenile cases.
