NEW: Parents begging for abortion of 'Baby Gabiel' regain custody of the child after the surrogate fled to Texas to have the baby. Nausheen Gilkar, 43, and Omar Ahmed, 45, were trying to have their surrogate, McKenna West, 28, abort the baby after the baby was diagnosed with hypoplastic left heart syndrome. The syndrome causes the left half of the heart to be smaller and unable to pump blood to the rest of the body. West refused to have the baby aborted and fled to Texas after finding a hospital with a high success rate with babies born with that condition. The baby was born, and an immediate life-saving surgery was performed on the baby West named ‘Gabriel.’ ‘Baby Gabriel’ is now in the custody of the parents who so desperately wanted to abort him.

ALERT: News anchor suing the station after being allegedly fired for calling her boss a “b*tch” during an argument caught on tape. Taryn Asher was a news anchor for WJBK-TV Fox 2 Detroit before being let go in November. Fox fired Asher after “unprofessional workplace behavior” and “outbursts.” Asher is now suing the station for s*x discrimination and retaliation. During an argument over a ‘PSA,’ Asher was recorded calling her boss a “b*tch” and saying, “What the f*ck. Grow up. Asher claims in the lawsuit that the station treated male coworkers accused of misconduct more leniently than it treated her.

ALERT: Farmer who attracted massive crowds by giving away free nectarines has been ordered to destroy his fruit trees. Cesar Mora is a farmer who was in a legal battle with Giumarra Brothers Fruit Company over the rights to his fruit. “Giumarra claims ownership of the variety of fruit Cesar grows and has sued him for breach of contract.” Mora claimed the agricultural giant blocked him from packaging or selling any of the fruit during an ownership dispute, so Mora gave away thousands of the fruit for free. Mora had a contract with Giumarra that claimed exclusive rights to his fruit, but Mora was allegedly selling to other distributors. After a 3-hour deliberation, a jury found that Mora was in breach of his contract but that he should not have to pay anything to Giumarra Brothers. Mora’s attorneys say they will appeal, but Mora has been ordered to destroy all of his nectarine trees by October. “I’m done. I mean, they came knocking on my door... So, how can I have a company that’s going out and trying to find small growers to sign them up for programs like this where all they do is harm me? They didn’t do many any favors. They didn’t do me any good.”

ALERT: Teen slams into a rock after trying to illegally jump off a famous San Diego cliff and comes up just a bit short. A 17-year-old decided to jump off Sunset Cliffs into the ocean while a crowd watched him slam into the ledge of the rocks and had to be rescued from the water. San Diego Fire-Rescue responded to the incident as well and transported the teen to a hospital; his injuries are unknown. Municipal codes prohibit jumping or diving into the Pacific Ocean or Mission Bay from any natural or human-made point connected to land that is more than five feet above the water.

LAWSUIT: Woman hit by a bat flung into the crowd is suing the New York Yankees for $10 million. Stephanie Duluc, 37, was sitting in her company's seats, 4 rows behind home plate. Cleveland Guardians player Jose Ramirez swung at a ball, and his bat flew out of his hands into the crowd and hit Duluc in the head. Duluc, who is the chief of staff at the Bronx-based SOMOS Community Care, suffered a traumatic brain injury from the blow, according to the lawsuit. The bat struck Duluc with “such force that it knocked her from her seat and violently threw her to the ground, causing her to sustain severe and permanent injuries.” Attorney Jon L. Norinsberg, the same attorney as the JP Morgan “s*x slave” case, alleges the protective netting did nothing to stop the bat and that the protective netting is significantly lower than adjacent stadiums. “It is the one location where the law has long required a stadium operator to provide adequate protective screening.”

ALERT: Prolific DUI driver decapitates a woman when he was allegedly drunk driving a pontoon boat 80 MPH in a no-wake zone. Richard Stevenson, 45, was seen flying across the Fox River in Illinois in his 30-foot pontoon boat, expected to be traveling 80 MPH. Stevenson was seen by a security camera zooming down the river and, about an hour and a half later, seen flying by again in the other direction. Shortly after, the family that recorded his boat heard a massive crash. Stevenson entered a no-wake zone and flew into the back of a boat, causing his boat to jump on top of it, decapitating a woman and injuring her husband. 2 passengers on Stevenson's boat fled the scene but were later interviewed by police and said Stevenson, who blew a .20 BAC, had taken several Fireball shots that day. Stevenson, who has 3 prior DUI’s, faces three felony charges, including reckless homicide and aggravated driving under the influence.

Javon Craword and his wife were visiting a sick relative in the hospital when they started getting alerts from their security cameras inside the home. They checked the footage and saw a live feed of his landlord, who was supposed to be removing dead birds from the attic, having what appears to be s-xual relations with a woman on his couch. Crawford said, “He was walking back and forth naked … He might have been making a sandwich.” Crawford has turned the security footage over to the police, and prosecutors say the landlord could be charged with trespassing or sued for violating portions of a lease agreement.

NEW: Frat bros arrested for allegedly trafficking cocaine and even forcing pledges to sell it for them in order to join their fraternity. Both Delta Upsilon and Sigma Chi members and former members at Penn State have been arrested in what was called Operation Drugs Unlimited. According to Attorney General Dave Sunday, the fraternities packaged and sold kilos of cocaine to students and locals near the college. Thomas Robinson, from Delta Upsilon, and Agostino Abbatiello, from Sigma Chi, are accused of being the top dealers, and Robinson’s father allegedly concealed the information from the police. Delta Upsilon has been temporarily suspended, while Sigma Chi is not affiliated with the school.

ALERT: Deck collapses as US Marshals and police try to serve a search warrant on a s*x offender. U.S. Marshals and other law enforcement officers in Missouri were on the second story of a deck, allegedly serving a warrant for failure to register as a s*x offender. Several injuries were reported, including four deputy U.S. marshals, two North Missouri Drug Task Force members, and one Randolph County deputy. ALERT: Research team found the Pan Am flight that crashed 74 years ago, killing 52 people, and changed airline industry standards forever. A Pan Am flight on April 11, 1952, was headed from Puerto Rico to New York with 64 passengers and five crew members aboard. It crashed shortly after takeoff due to both right-side engines failing. Although all passengers survived the initial impact, only 17 were rescued, while the others sank with the plane, which investigators blamed on a lack of safety briefings. Because of the incident, airlines adopted the safety briefings we hear before takeoff today. Air/Sea Heritage Foundation, along with Discovery Channel’s “Expedition Unknown” show, found the wreckage of the Pan Am “Clipper Endeavor” at the bottom of the Atlantic Ocean off Puerto Rico’s coast. Josh Gates, a host of “Expedition Unknown,” said, “Every time you step onboard an airplane today, you are safer because of what happened to ‘Clipper Endeavor’ and her passengers three-quarters of a century ago.”

ALERT: Woman in the dressing room of a Nordstrom allegedly caught a man recording her under the stall door in Southern California. Sophia Schades alleges the man hit a phone in a crumpled-up shirt on the ground and was recording underneath the wall of the dressing room stall. Schades immediately confronted the man and banged on his dressing room door, and he tried to hide his face behind a shirt. Mall security said they would keep an eye on him, but by the time police arrived, the unidentified man had gotten away. Schades has been looking for help from social media in identifying the suspected pervert and has filed an official report with the Cerrito Sheriff's Department. “I am not going public with the name yet, as I need to confirm with the police due to defamation laws. ALERT: Maintenance worker stuck 130 feet in the air inside a gas station sign after his lift malfunctioned. A man in Wilmington, Illinois, was working on a gas station sign off Interstate 55 when he became trapped in the sign due to a lift malfunction. Fire officials responded and had a hard time finding a lift big enough to retrieve the man from the sign, as their equipment is usually only 100 feet tall. They found a lift tall enough on a job site in Joliet and had the Illinois State Police escort the lift ot Wilmington. They successfully got the man down after he spent nearly 5 hours trapped 130 feet in the air.

ALERT: Hospital ran out of anti-venom trying to save a father of 3 who was bitten twice by a rattlesnake. Christopher Howarth was visiting his parents in Oroville, California, and went into their backyard to check on a leaking pipe. Howarth stepped on what he thought was a plant, but it turned out to be a deadly rattlesnake that bit him twice on the foot. When his wife Jenny found him, his lungs had begun failing, his tongue was numb, and his lymph nodes had ballooned. Suffering from a rare blood-clotting condition, the hospital used 54 vials of anti-venom by day 3 and ran out by day 5. “I wasn’t sure if I was going to pull through. At one point, I wrote some letters to my kids to make sure they had one last letter from Dad.” The Norcal hospital then transferred Howarth by helicopter to Stanford Hospital, and their anti-venom helped subdue his symptoms. Thankfully, Howarth is now back at his Idaho home with his wife and 3 children after 12 grueling days in the hospital.

Authorities say the man operating the vessel suddenly fell overboard, and the Coast Guard had to intercept and stop the boat. ALERT: Small town in New Jersey was rocked this morning after a plumber got in his car and it exploded. Residents in Totowa were awakened at around 5:40 AM to the sound of a car explosion. Officials believe an acetylene tank, a highly flammable gas used for welding, was slowly leaking in his trunk and ignited. The man got out of his car on his own and was taken to the hospital for evaluation. Neighbor Sheldon Blaine said, "Our house, our windows was facing the explosion, they are all blown in. There are piece of the car inside of the house."

ALERT: Illegal firework leaves a California teenager who graduated 3 days earlier handless after it explodes in an In-N-Out parking lot. Nader Hanna, 18, met up with his twin brother and some friends outside of the Pleasanton In-N-Out Burger to get some food and set off fireworks in the parking lot. Nader, who said the group of teens had done this several times, said his buddy handed him a tennis-ball-sized firework, which immediately exploded when he lit the fuse. “It just exploded in my hand the second I lit it… My hand took the whole blow. I looked down, and I didn’t see a hand. It disintegrated.” His twin brother Ramsey frantically called 911 as his friend, Kevan Mokashi, ran inside the restaurant ot seek help with Nader's exploded left hand. The Pleasanton Police Department said they will not cite Nader due to the severity of his injuries and that the firework is believed to be an illegal one and not a California legal firework of the “safe and sane” variety.
