A California judge released an illegal immigrant on his own recognizance Wednesday. One day later, 68-year-old Todd Stewart — a retiree who lived on his quiet Martinez street for 40 years — was dead, allegedly stabbed during a botched burglary. Marcos Iriarte-Valdez was already facing burglary charges for breaking into occupied homes in April. He was arrested Tuesday for violating home-detention conditions, then released the very next day. DHS says it has now placed an immigration detainer on him and is demanding Gov. Gavin Newsom hand him over. Iriarte-Valdez is from Venezuela, was legally admitted during the Bush administration, but has since been classified as an illegal alien. He's now charged with murder, spousal corporal injury, three counts of burglary, receiving stolen property, trespassing, and violating a protective order. He's being held without bail.
