Since I got attacked for calling what Natasha Hausdorff is saying here nonsense, here's the actual legal breakdown. This argument misunderstands how international law works because it mixes together three different legal questions: (1) who has sovereignty, (2) what uti possidetis juris means, (3) what constitutes an occupation. She’s right that uti possidetis juris was meant to preserve existing colonial administrative borders when colonies become independent. It was developed mainly in Latin America and Africa to prevent newly independent states from fighting over borders. But the rule does not say that whichever new state emerges automatically inherits every inch of a former colony. Unlike in Latin America and Africa, there was no single, uncontested successor after the British Mandate in the context of Palestine. The British ended colonial rule, the UN Partition Plan was never implemented as binding law, war broke out, Israel declared independence, Jordan took control of the West Bank, and Egypt administered Gaza. This sequence of events is why international law practitioners generally reject the application of uti possidetis to the Israel/post-Mandate context. Even if someone believes that Israel had a stronger territorial claim in 1967, that still doesn't address the occupation point. Under IHL, occupation is based on effective military control, not on who has the better sovereignty claim. The reason why the law of occupation exists is to protect civilians while territorial disputes remain unresolved. Whether a war was defensive or whether the previous controller had lawful title does not determine whether occupation law applies. This is exactly why the ICJ has consistently held that the West Bank (including East Jerusalem) is occupied territory. The court was fully aware that Jordan's annexation of the West Bank was not widely recognized and that Egypt never claimed sovereignty over Gaza. Even so, it still concluded that Israel is an occupying power because occupation is a question of control, NOT settled sovereignty. Even if uti possidetis applied, she completely ignores the Palestinian right to self-determination, which is distinct from territorial succession claims. International law recognizes both the law of occupation and the Palestinian right to self-determination regardless of unresolved sovereignty claims. These aren’t issues that boil down to a simple political disagreement; the facts can’t be disputed. I encourage her and everyone to look at the relevant ICJ advisory opinions from 2004 and 2024, the ruling in Burkina Faso v. Mali, and Article 42 of the Hague Regulations.
