This indictment of Comey seems comically thin. Here’s the alleged statement from Comey and the testimony from McCabe. Courts routinely find that answers that are literally true or responsive but non-misleading cannot support criminal liability. Here, Cruz framed a compound, conclusory question and Comey did not adopt the accusation about McCabe and instead said “mine is the same today,” i.e., he stands on his prior testimony. If the government thinks some earlier answer was wrong, that is a different theory than alleging a new false statement on 9/30/20. Moreover, McCabe’s testimony does not establish authorization: McCabe basically said: “I didn’t need James Comey’s authorization” and “I didn’t ask Jim Comey …” He doesn’t contradict what Comey said.
