Giggle v Tickle: The End of Women The High Court of Australia has refused Sall Grover special leave in Giggle v Tickle. That is the end of the road in the Australian courts. A woman who built a female-only app cannot exclude a male from it on the basis of a “perceived male appearance”. Gender identity now trumps sex in our federal discrimination law. The special measures provision in the Sex Discrimination Act no longer protect women’s spaces when the claim is brought on the basis of gender identity discrimination - feelings now override facts. This is not a narrow ruling about one app, transactivists are a notoriously litigious lot and they will weaponise this decision to bring everybody into line with their worldview. They tried it on in the USA and the tsunami of complaints and litigation has already hit the shore here. It is the High Court declining to disturb a construction of section 7D of the SDA that treats sex as changeable and women’s boundaries as optional (as was decided by the lower courts). For a nation so obsessed with consent, it is ironic women can no longer say NO. ❓Where are all the moderates and vichy feminists now? Parliament wrote this law in 2013, only Parliament can fix it. ❌Labor started this war, they certainly won’t end it and admit their catastrophic mistake. 🧡One Nation was the first political party to table legislation (in 2020!) to preserve sex-based rights, protect children from indoctrination and halt the encroachment of this dangerous dogma into every aspect of our society. ‼️Define sex as biological sex. ‼️Restore the right of women and girls to single-sex spaces, services and sport. ‼️Stop using the curriculum to indoctrinate toddlers, children and teenagers. ❌Until that happens, the SDA no longer does what its name says. Police, courts, prisons, borders. We are not allowed to take that power into our own hands, and in return the state owes us a duty of care. That duty is not abstract. It is the difference between a girl walking home and a girl who never gets to. That duty is being broken. This week an ACT Supreme Court judge suspended the jail term of a non-citizen who pleaded guilty to sexual intercourse without consent. He had been in the country about six months. The court treated his “limited insight into societal norms in Australia” as something that reduced his moral culpability. Read that again. Not knowing that rape is wrong, because you have only just arrived, was used to soften the sentence. That is not an isolated excuse. It sits in a pattern. Visas restored because deportation would cut someone off the NDIS. Because they might lose Medicare. Because they have “ties”. Because removal would be hard on them. The simple thing is this. A visa is a privilege, not a right. Once a non-citizen rapes or sexually assaults an Australian, that privilege is finished. Not after a tribunal weighs their treatment plan. Not after a report says they might be safer on the NDIS than on a plane. On the first available removal. I am a mother of daughters. I do not want these men in my country. They had no right to be here the moment they chose an Australian girl or woman as a target. The rest of us are told to trust the state with our safety. Then the state keeps the predator and calls it compassion. Compassion is for the victim. The border is for everyone else. If you have raped or sexually assaulted an Australian citizen, you should be on the first plane out. No cultural discount. No NDIS discount. No Medicare discount. Out. Australians deserve better. Especially women & girls.
