Cheshire police have released another statement to the press this morning, "confirming that they have submitted a full file of evidence to the Crown Prosecution Service, for charging advice, on the ongoing investigation into deaths and non-fatal collapses of babies at the neonatal unit at both the Countess of Chester Hospital, and the Liverpool Women's Hospital too," per BBC Breakfast. The Crown Prosecution Service, in their own statement, confirm they've received the file from police, and will be reviewing it. The CPS stress that any future decision to charge, "will be made independently, based on evidence, and in light with our legal test," and that they won't be making any further comments until/unless further charges are brought.

In his 60 Minutes Australia interview, Dr Dewi Evans dismisses the findings of Dr Shoo Lee's expert panel as "about as weak a group of opinions that I've ever seen." At Letby's first trial, Evans was singing a different tune about Lee's credentials & research, referring to his 1989 paper on air embolus as a kind of gold standard in the field.

Late last night, Liz Hull published a remarkably dishonest article in the Daily Mail. (See quoted tweet.) The headline and lede claimed Letby was on duty for 12 of the 13 baby deaths during the relevant indictment period. That's not true. Liz Hull knows it's not true. She admits this herself in the article, in the most underhanded way possible: "Letby was on duty or had been on shift less than a couple of hours before five of the six other babies died." In other—clearer—words: Letby was not on duty when some of these babies died. Rather, she was on duty on the shift that preceded these babies' deaths. What's even more remarkable is that Hull, only four months ago, argued in her own podcast that nine deaths for which Letby was never charged were expected and explained. You can listen to what Hull said about those deaths in the clip below. Here are some excerpts: "Four of them were born with serious congenital defects, so were completely discounted in the case. Their deaths were not suspicious. They were expected." "One of them suffered severe asphyxia and brain damage at birth." "Another four died of infection." "From what I can gather, from talking to people that looked at the notes and were very, very close to the case, those babies that died with infections weren't part of the indictment because their infection followed a pattern, which was expected, and they died of that infection."

Dr Dewi Evans spoke to Radio Wales Breakfast this morning. It is a fascinating interview—in particular, Evans' response to the question of whether he'd changed his mind on what caused Baby C's death. For context: Evans testified at trial that Lucy Letby murdered several babies by forcing air down their nasogastric tubes. But there is nothing in the scientific literature supporting this as a plausible method of murder—a fact Evans himself has had to concede post-trial. Evans has since recanted his theory, telling Channel 5 last summer that, "None of the babies were killed as a direct result of the injection of air, or fluid and air deliberately injected into their stomachs." More recently, Evans has denied that he ever recanted his original murder theory in the first place. The latest about-face came in response to Letby's new lawyer, Mark McDonald, announcing that he will seek to appeal Letby's convictions—based, in part, on Evans having changed his mind about this particular method of murder. And that brings us to Evans' interview this morning with Radio Wales Breakfast. When asked if he'd changed his mind about what caused Baby C's death, Evans equivocated. He told the interviewer that Letby may have "used both mechanisms"—meaning air forced down the nasogastric tube, and air injected directly into the baby's veins—and that, "either option was possible." It's a response reflective of the impossible position Evans has put himself in. He's no longer willing to stand by 'air forced down the nasogastric tube' as a feasible method of murder, but is similarly unwilling to admit that he's changed his mind.
