Jeff Shafer argues that a series of Supreme Court decisions—from Griswold and Eisenstadt to Roe and Casey—systematically severed the natural connections between sex, marriage, and children. In his view, the law progressively redefined these realities as independent of one another rather than as parts of an integrated whole. Shafer contends that the result is a legal vision in which sex is ideally understood as sterile, family relationships become increasingly fragmented, and human freedom is defined by the power to redefine reality itself. The Supreme Court's opinion in Obergefell v. Hodges was driven more by sentiment than by serious constitutional reasoning. Rather than engaging with legal history, precedent, or the nature of marriage, the majority opinion appealed primarily to emotion while offering little substantive justification for redefining one of civilization's oldest institutions. Jeff Shafer's conclusion is straightforward: whatever one thinks of same-sex marriage, the legal reasoning behind Obergefell should not be mistaken for a compelling or rigorous constitutional argument.
