🚨 BIG ruling in the Lindsay Clancy trial: The judge will allow the jury to consider manslaughter in addition to: • First-degree murder • Second-degree murder • Not guilty by reason of lack of criminal responsibility So the jury now has a middle-ground option if they believe Clancy was criminally responsible, but the evidence does not support murder. The judge also denied the defense’s requested Bowden instruction regarding alleged flaws in the police investigation. The manslaughter ruling is the bigger development. 👀

🚨 WAIT. OH MY GOD‼️ This exchange today was WAY bigger than it sounded in real time. The prosecution asked Dr. Saathoff whether automatically obeying a command hallucination is a red flag when evaluating possible malingering. He said YES. Now here’s the insane part: That warning comes from Dr. Phillip Resnick’s own teachings. The SAME Dr. Resnick who testified for Lindsay Clancy’s defense and said he believed she was psychotic. So the prosecution basically used the defense expert’s own framework to challenge the story he accepted. And Reddington OBJECTED. Now I understand why he was mad. Because if Clancy’s account contains the exact kinds of warning signs Resnick teaches other psychiatrists to scrutinize, then the obvious question is: WHY DID HE DISCOUNT THEM HERE? That does not automatically prove malingering. But holy hell, it raises a MASSIVE credibility problem for his opinion. This clip just became a lot more important.

The suicide hotline did not simply “turn Lindsay away.” I’ve worked in substance abuse and mental health treatment for 15 years, in both inpatient and outpatient settings, and these levels of care matter. Dr. Saathoff testified today that she was offered a PHP — partial hospitalization, essentially structured day treatment for hours at a time, often several days a week — and an IOP, which is intensive outpatient treatment, not inpatient care. Those are real, substantial levels of psychiatric treatment. And an emergency psychiatric admission or an involuntary 72-hour psychiatric hold is not automatic just because someone reports suicidal thoughts. A person generally has to meet specific legal and clinical criteria for involuntary hospitalization. The evidence here was that she was offered treatment options short of inpatient commitment. She was not simply turned away. That distinction matters.
