Despite emergency medical efforts, he was pronounced dead at the hospital. The suspect, Davy Spencer, a 47-year-old Wilmington resident, was arrested after a five-day investigation. He now faces charges including second-degree murder and two counts of assault with a deadly weapon with intent to kill. Spencer has an extensive criminal history that includes multiple felonies and violent offenses. He was previously designated a habitual felon in 2015–2016 after convictions for cocaine and heroin trafficking, for which he served approximately 117 months in prison. Despite this long record, he was back on the streets — raising serious questions about repeated releases by judges and the justice system. A memorial has been set up at the corner of Front and Princess streets with American flags, and the Montano family has launched a fundraiser to cover funeral expenses.
