Derek Chauvin is affirmatively innocent. He did not cause George Floyd's death. TJ Harker, former New Jersey DAG and federal prosecutor, and author of the upcoming AMERICAN SCAPEGOAT, has done a deep dive on the Chauvin proceedings. The State ruled out an air choke the day after Floyd died. It rode a blood-choke theory into trial. Then its own witnesses said you cannot kill a man by compressing one carotid artery. Mid-trial they abandoned it and pivoted to an asphyxia theory that their own medical examiner would not endorse. Indeed, he was bullied into adding "neck compression" to his statement of what caused George Floyd's death; it wasn't there at first. And that's only the beginning of the problems with the Chauvin trial. The Right has turned on Flock Safety. In the past few weeks, it’s been hard to scroll X for even five minutes without running into some anti-Flock screed, or some news about Flock's automated license-plate reading cameras (ALPRs) being destroyed by angry citizens. And I can recall few instances of a private company raising so many passions. It’s no surprise that the radical left wants Flock obliterated. If Antifa and Black Lives Matter types are unable to defund the police, the next best thing would be to strip the police of their tools. But many forces on the right want Flock cameras gone as well. Senator Josh Hawley of Missouri has launched an investigation into Flock’s practices. Governor Ron DeSantis of Florida has decided to take down the Flock cameras owned by the state government. This week, Jacob Coxon’s Anthropic resignation thread went mega-viral on X to a degree that made many, including Elon Musk, suspicious. New on Counterweight: Randy Barnett takes us through his years as a prosecutor, with stories of true crime and corruption that are worth hearing. Randy is the Patrick Hotung Professor of Constitutional Law at the Georgetown University Law Center and the Faculty Director of the Georgetown Center for the Constitution. He's authored more than a dozen books and appeared before the United States Supreme Court in 2004, where he argued Gonzales v. Raich. But before any of that, Randy was a prosecutor in the Cook County State's Attorney's Office in Chicago in the late 1970s and early 1980s. His latest book, FELONY REVIEW, is the story of those years: learning how to be a prosecutor on the job, coming face-to-face with brazen corruption in the misdemeanor courts, working night shifts at police stations reviewing every potential felony charge that came through the door, and ultimately trying major felony cases. Four days after George Floyd died, another medical examiner called Dr. Andrew Baker unsolicited. He said he planned to publish an op-ed with the Washington Post that was critical of Baker's autopsy. Then he said, “Neck compression has to be in the diagnosis.” A few days later, neck compression was in the cause of death. Prosecutors sat on the call for months. In the federal grand jury, Baker was asked whether anyone had tried to influence him. He asked to step outside and speak with his attorney. Tessa Harker explains on Counterweight.
