Costco is a private owned company. They can tell you not to record and have every right doing so. It's not against the law to record. But if the store ask you stop or leave they are well within their rights and legally allowed to do so.

Some of these 'audit' videos are accurate with assertion to film from private property. But this is too far. 'Publicly available' isn't a thing and he is clearly on the property owned by Costco. Consider, if he slipped on ice and injured his self, could he go after Costco - yes. But not if he was on a public sidewalk or road.

Filming Costco from a public sidewalk would have been perfectly legal for this dude to record, getting the same images. Publicly accessible is NOT the same as simply being in the public view.

The worst part of watching First Amendment auditors film in public is the Karens and Kens who get openly hostile about being recorded.
