🚨BREAKING: SEC CHARGES FLAMBOYANT HEX FOUNDER RICHARD HEART FOR MISAPPROPRIATING MILLIONS IN $1 BILLION CRYPTO RAISE The SEC has charged Richard Heart, the founder of one of Crypto's most controversial projects and the owner of a plethora of luxury goods, including the world's biggest diamond. BREAKDOWN OF CHARGES: 1) Conducting unregistered crypto asset security offerings The offering raised more than $1 billion in crypto assets from investors. Heart attempted to evade securities laws by asking investors to “sacrifice” crypto assets, instead of "invest" in exchange for PLS and PLSX tokens. 2) Misappropriation of funds The value of the misappropriation is approximately $12 million, the SEC stated. Heart allegedly called on investors to buy crypto asset securities in offerings that he failed to register. He then defrauded those investors by spending some of their crypto assets on exorbitant luxury goods, including sports cars, watches, and a 555-carat black diamond known as ‘The Enigma’. 3) Fraud in connection with the sale of the security The SEC claim Heart used a strategy known as “recycling” transactions, that enabled Heart to surreptitiously gain control of more Hex tokens. Heart and his co-conspirators had given the false impression of significant trading volumes and demand for Hex by using their own funds. The SEC estimates up to 97% of the investment volume was Heart and his accomplices’ funds. WHAT'S NEXT: The SEC is seeking injunctive relief, disgorgement of ill-gotten gains plus prejudgment interest, penalties, and other equitable relief. As you probably know by now, the SEC has a very high success rate in winning cases or reaching a settlement when they file charges. At the same time, unregistered token offerings have a history of settling with the SEC for a small amount of money. Remember the EOS settlement with the SEC of $24 million when they raised OVER $4 BILLION IN THEIR ICO? It's important to note that these SEC charges are all civil charges.
