So why can't Duffy just revoke them all? He can—and he should! The 1986 Commercial Motor Vehicle Safety Act required CDLs only for drivers domiciled in the issuing state—no foreign exception was included or approved. The entire illicit provision was later created by FHWA (now FMCSA) in their July 21, 1988, rulemaking (49 CFR § 383.23), using broad delegated authority. There was zero congressional oversight and zero votes—just an agency invention. Even then, they couldn't have foreseen how this might later be abused. This loophole lay mostly dormant until 2019, when the same agency (with ATA's support) issued guidance expanding the loophole! Then, in 2021, the Biden-Harris Trucking Action Plan opened the borders and fast-tracked hundreds of thousands of unvetted and unqualified truck drivers to take over our highways using the loophole created in 2019. That's right—this was done in secret and without the approval of the American people or the people we elected to represent us. This “loophole” lives in regulations, not law, so it can be restricted or eliminated without Congress. We need full revocation through executive order or additional agency action, not new statutes making it permanent. Say no to H.R. 5688—it's a Trojan horse. The FMCSA (under DOT) in continuing an ongoing audit of IL SOS office related to the issuance of at least 10,000 non-domiciled commercial driver's licenses over the past few years. These are truck driver's licenses awarded to non residents--foreigners--including some here illegally. In 2024 and 2025, the state saw a huge jump in the number of non-domiciled CDL issued by IL SOS. In fact, an industry watchdog group obtained records via FOIA that showed roughly 40% of ALL CDLs issued by IL SOS in 2025 went to foreigners. FMCSA determined at least 20% of all non-domiciled CDLs issued by IL SOS were done so illegally. Applicants did not furnish federally required paperwork including unexpired passports and IL SOS issued CDLs for a longer period of time than the applicants' work authorization permitted. The audit also "uncovered evidence of systemic policy, procedural, and programming errors" in how the IL SOS handled non-domiciled CDL applications. Nonetheless, IL SOS is fighting FMCSA's findings, claiming that "every non-domiciled CDL applicant in Illinois presented validly immigration documents." IL SOS also refused to revoke/suspend the unlawfully issued CDLs officials identified in the FMCSA audit. So at the same time the feds are looking into whether hundreds, perhaps thousands, of non domiciled CDLs were illegally issued to foreigners in Illinois and a major trucking carrier in Illinois is under federal investigation for numerous issues--Chicago media says nothing.
