In January, the Free Speech Union’s General Secretary, Lord Young of Acton, coordinated a letter to the Digital Secretary, Liz Kendall, urging her to commence vital free speech safeguards in the Online Safety Act. The letter was signed by 56 peers — including three former Cabinet ministers — as well as the editor of The Spectator, Lord Michael Gove; former Deputy Prime Minister, Baroness Thérèse Coffey; and Lord Lilley. It was also signed by two former national newspaper editors — Lord Moore of The Telegraph and Baroness Fleet of the EveningStandard — along with the chairman of the Independent Press Standards Organisation, Lord Faulkes. Two months on, the Secretary of State has still not responded. Today, in the House of Lords, Lord Young asked Baroness Chapman to raise the matter with her government colleague. One safeguard relates to increased protections for journalistic content, while the other would ensure that social media platforms take into account the “importance of the free expression of content of democratic importance”. Today was supposed to be the Chagos Surrender Bill going through the House of Lords. Instead, Labour suffered a humiliating defeat, by the Conservatives in the Lords and forced to withdraw their bill. The Labour Party have rushed this Chagos surrender bill to appease their left wing lawyers, whilst overlooking the US-UK 1966 treaty, stating the British Indian Ocean Territory shall remain under the United Kingdom sovereignty. The Conservatives will continue to fight to completely kill this shameful bill.

One of Bridget Phillipson’s first acts as Education Secretary was to pause commencement of Section 8 of the Higher Education (Freedom of Speech) Act — the provision that would have introduced a complaints scheme for students and academics. Despite a partial U-turn and a promise to bring forward a revised scheme – she wants to stop students from being able to complain about the activities of students unions – she has dragged her feet. The Department’s excuse is that introducing a revised complaints scheme would require amending a suitable bill — and none is currently in sight. This afternoon, the Free Speech Union’s General Secretary, Lord Young of Acton, informed the Skills Minister, Baroness Smith, that the House of Lords Library has advised him that Section 8 could be partially commenced via secondary legislation in a way that addresses the Education Secretary’s stated concerns, i.e., allowing academics and visiting speakers to complaint to the OfS, but not students. There is no constitutional requirement for this to be done through primary legislation — so why the delay in guaranteeing that free speech protections are properly enforced on campus? The legislation will be based on three principles: 1) An early dismissal mechanism that allows judges to balance freedom of expression vs the claimant’s rights; 2) Express case management powers allowing for a determination to be made on the papers; 3) A mechanism to protect defendants from adverse costs if the case is found to be a SLAPP. “We have the opportunity to achieve what everyone wants and end the abuse of our legal system which threatens fundamental principles and, at the same time, doing it by maintaining access to justice,” Baroness Stowell said. Before the weekend, I gave my last speech on the last day of the Assisted Dying Bill, which has run out of road. Despite conspiratorial smears about filibustering peers, there were actually lots of fine speeches about the challenges of legislating to allow the state to assist people in taking their own lives. The problem for Kim Leadbeater and Lord Falconer is that they were more interested in parading celebs and winning the media war to bully peers into nodding the Bill through, and also seemed uninterested in winning over critical members of the public or worried disabled people. And just a bloody cheek to blame the Lords for eroding trust in parliament - have they looked at the shenanigans of their own Party/leader?

Lord Macdonald of River Glaven KC has recently completed his review of public order and hate crime legislation, commissioned by the Home Secretary. The central question of how to tackle extremism while preserving freedom of expression falls squarely within the scope of Lord Macdonald’s review. Today in the House of Lords, the Free Speech Union’s General Secretary, Lord Young of Acton, asked Home Office Minister Lord Hanson of Flint what had become of the review and when peers would be able to examine its findings. The Minister confirmed that the Home Secretary has received the review and is considering Lord Macdonald’s recommendations. He also committed to publishing it before the summer parliamentary recess. Guy Benson (Guy Benson) appeared on Fox and explained why there aren't DOGE cuts codified in the Big Beautiful Bill: "A lot of conservatives are wondering, 'why aren't a lot of these cuts that were identified by Doge and Elon Musk codified in the big beautiful bill?'" "The answer is that they can't do it in the reconciliation package because it's discretionary spending." We can't let the GOP drag their feet on this. It starts on Monday when the first cuts are sent from the White House to Congress. DOGE cuts MUST be codified!

And of course Tanni’s right, this is a private member’s bill, there’s no convention that says it has to be passed… “There will be ill-feeling if it doesn’t get through, by some sectors, and I think we have to recognise that. But if the House of Lords feel the haven’t had sufficient time to scrutinise it then we have to respect what they do.” Iain Dale: “You voted for it?” NSH: “I voted for it, I will be disappointed if it doesn’t become law. But I also recognise the importance of respecting the House of Lords and the role that they take. I don’t think those are necessarily contradictory points. I may disagree with some of the points that are being made up there, but that’s the purpose of debate.”
