Court would likely side with the officer that with both smell (though a lie, courts would likely view it as a mistake) and appearance of an alcoholic beverage bottle gave him reasonable suspicion for a short detention. He investigated, found out it was a soda and released the citizen. Under the current interpretation, I'd say courts would find no unreasonable 4a violation.
