Umar Khalid has spent 6 years in jail. Without a trial. There are 900 witnesses in this case. The trial cannot finish anytime soon. Justice Dhulia pointed out the real question: -> In the same judgment, the Court itself set certain parameters and granted bail to 5 other accused. -> Umar did much less by those very parameters, he said, yet it was never explained why he was left out. -> He also asked where the one-year bar on applying for bail again even came from. His words: "Chakka jam doesn't mean six years in jail." Bail is not freedom from the case. It's not an acquittal. It's the simple rule that undertrials are not punished before they're proven guilty. Another former judge, Justice Madan Lokur, called the denial "sad." Bro, imagine your son and his friend are picked up in the same case, on the same day. Same chargesheet. Same courtroom. Same judge.
