@benshapiro A bit of nuance. While you certainly shouldn't let trump off the hook. It does makes sense to distinguish levels of intent. Would you call distinguishing between 1st degree murder murder, 2nd degree, and manslaughter, grading on a curve? After all, the result is the same.
