Why NY AG Letitia James can’t argue her fraudulent mortgage applications were accidental from a former Mortgage Loan Originator: Primary residence vs. second home vs. investment property. - Interest rate increases with risk factor of non-primary residence mortgage repayment has already been well discussed… this is the LEAST important component to the lie for gain. - Minimum down payment percentage required increases significantly with secondary and investment properties. - Additional qualification requirements for second homes and investment properties include lower debt to income ratios, minimum required liquid reserves, down payment gift sources not allowed, minimum required credit score, minimum trade line history and credit report requirements, etc. - Purchase of a principal residence in a state where one is not employed requires at minimum a letter of explanation signed by the borrower, but typically a letter on company letter head from employer stating the employee works remotely, etc. Underwriting would have REQUIRED documentation in the file in order to sell the loan in the secondary market (to Fannie/Freddie) - Automated Underwriting is significantly stauncher on non-primary residences. Any mixture of minimal poor credit history, minimal reserves (i.e. only 7 months of reserves for a 6 month reserve requirement,) debt to income ratio close to the limit, etc. will return a CAUTION/REFER in automated underwriting automatically requiring denial or SIGNIFICANTLY more documentation such as verification, additional reserves, longer seasoning requirement for reserves, higher down payment down, addition of a co-borrower, etc. She committed fraud to obtain the property in every form financially… not just for a lower interest rate. She committed fraud to QUALIFY. POA means literally NOTHING in mortgage fraud. If she thought that would protect her, she’s the dumbest lawyer in America. All of the above applies to the 1-4 vs. 5+ unit property mortgage for New York, as well. If she doesn’t receive the maximum penalties allowed under both state and federal law I will personally be picketing her office door. She had to sign multiple documents acknowledging the violation of mortgage fraud, even one from the FBI, as part of both her application and her closing. SHE IS A CRIMINAL.
