He claim that SPs and DCs can directly detain individuals and send them to jail. This is not a legal precedent; it is an illegal one. Furthermore, the Assam government is repeatedly pressuring our courts and tribunals, pressuring them to declare people 'foreigners' at any cost, and is also pushing for a process to remove them once declared foreigners. That is why this Supreme Court verdict serves as a warning to our government to uphold the rule of law. Holder: The Supreme Court is a broken institution. And it’s something that has to be part of the national conversation in ’26 and in ’28. If there is a Democratic trifecta in 2028—and I think the possibility of that is pretty good—Supreme Court reform has to be on the table. Term limits, at a minimum, and potentially expanding the Court are things that should be seriously considered. We cannot leave in place, without at least a discussion—and I think without substantive reforms being implemented—the Supreme Court as it is presently constituted.
