It's really important to understand that not only has there been no genocide in Gaza, it's the opposite. It's actually the most humane, the most precise urban warfare fight the world has ever known. It's a war that was run, for the most part, by lawyers, international law scholars and lawyers called MAGs, military advocate generals, who are deployed in the field with the commanders, thousands of them, and who evaluate every action, every strike. And unlike here in the United States, where JAG officers give advice to commanders and say, "Hey, this is a precatory piece of advice. You can disregard it if you want," in Israel, the MAG's advice is not precatory. It's a mandatory order that must be followed by the commander. Every single day in Gaza, strikes on legitimate military targets are canceled, and I've seen this with my own eyes dozens and dozens and dozens of times, because of the risk of collateral consequences to civilians in Gaza. That's the very opposite of genocide. Think about real genocides in history. When you take the Nazis, for example, who pushed my mother's half-brothers and sisters into the gas chambers, they weren't looking to warn civilians to get out of the killing zone. They weren't looking to cancel strikes, which is to say a gas chamber, because there were too many civilians near the gas chambers. The whole purpose, the whole architecture of a genocidal regime was to push the civilians into the killing zone. Israel cancels strikes because of a fear of civilian casualties. It employs the most sophisticated civilian warning system the world has ever seen that gets civilians out of the killing zone in the war. Israel then shepherds them to safety, provides them with food purveyors, medical clinics, and the polio vaccine for 98% of the children in Al Mawasi—given for free by the Israeli government and by Israeli doctors to children in Gaza—this is the very opposite of what we would expect if there were a genocide.

And this is the guidance that he’s giving to the force. And somehow our senior military leadership is bending the knee and carrying out any order that Hegseth is directing, no matter how illegal, unconstitutional, unethical or immoral. I’ve heard over and over again him responding combatively to our US representatives and to media about how so-called precise the US is and nobody’s better at protecting civilians and the innocent. I would argue that if we were that good, we wouldn’t have just completely negligently dropped missiles on hundreds of young schoolgirls in Iran. John Spencer, Richard Kemp, and Andrew Fox are experts in the field of urban warfare, and I detail their findings in my new book, Israel on Trial: Examining the History, the Evidence, and the Law. In urban warfare, the average militant-to-civilian casualty ratio is about 1 to 9, meaning one militant killed for every nine civilians killed. That's not because every war that's ever been fought is a genocide. It's because war is horrible and urban warfare in particular is horrible. That's why Israel would much prefer to fight Hamas out in the open. It's Hamas who chooses to fight in Gaza underneath its civilian population precisely to increase—not decrease—the number of civilian casualties. In the American war in Iraq and Afghanistan, we and our allies set the gold standard. We had a militant-to-civilian kill ratio of about one to four-and-a-half, maybe one to five, and many experts believed no army would ever be able to meet that standard again. In much more difficult and complicated circumstances, Israel, even if you believe Hamas's bogus numbers—which you should not believe for all the reasons I lay out in the book—but even if you took Hamas at completely face value and you believed all of their numbers, Israel has a militant to civilian kill ratio of about one to one-and-a-half in Gaza. If Israel has committed genocide in Gaza, then the Americans committed genocide in Iraq and Afghanistan, then the Americans and the allies committed genocide in Germany and Japan, and literally every war that has ever been fought in human history has been a genocide. That's not what genocide means. We should reserve the label for the crime of all crimes, because otherwise the consequences will be dire.

Israel’s doing the very opposite of genocide. Israel does everything in its power to move civilians out of harm’s way in order to preserve and protect them. I'll give you an example. Israel, at the beginning of the war, would warn civilians to get out of harm’s way. They would say, “here are the areas that we’re going to attack tomorrow, the next day, and the day after that you need to leave so that we can fight Hamas who’s hiding in those places.” Already that’s the very opposite of genocide. Genocide requires an army to be pushing civilians into the killing zone. Here’s an army warning civilians to get out of the killing zone. But here’s the thing, over time Israel learned that Hamas was not going to tolerate that. Hamas, we know from their private correspondence, they want more civilians to die, not less. They want to convince the world that Israel is bad, so that Israel can be easily destroyed. So they start killing civilians who are fleeing the war zone. They start at gunpoint, forcing civilians to go back into the places that Israel is going to attack in order to increase the amount of civilian casualties. Israel learns about this and what does Israel do? Israel starts building these humanitarian corridors—these are unheard of in warfare. They started at 4 hours a day, 8 hours a day. Ultimately there were 16, sometimes 20 hours a day, where Israel would man these highways that they would create. They would put their own soldiers, Israeli sons and daughters on the front lines of these highways to sit there and guard Palestinian civilians from other Palestinians as they fled the war zone to make sure that Hamas couldn't kill them as they fled. Again, that’s doubly the opposite of genocide and the numbers bear this out. In fact, every month since the war went on, you see the ratio of militants-to-civilians killed get lower and lower and lower so that ultimately, at the end of the war, when they go into Rafah—where Israel moved 1.2 million civilians out of harm’s way in order to destroy the final stronghold of Hamas in southern Gaza—you see the lowest civilian casualties of the war, at the end of the war. Again, it’s the very opposite of a genocide.
