Reporter: This indictment charged against James Comey was never actually presented to the full grand jury. The original indictment that Lindsey Halligan presented was 3 counts. That grand jury felt that there was not enough evidence to charge Comey on one of the counts. Halligan reprinted a new version of the indictment, and instead of re-presenting it to the full grand jury, she just had the foreperson sign it. This is a major procedural mishap because the indictment against him could be seen as invalidated.

AG Todd Blanche was pretty tight lipped about the evidence they have on Comey, but he said that they are looking at devices and there was a communication that was sent in this case. “There’s a communication that was sent allegedly in this case, and so that means that we have to look at devices…” Is he referring to the Instagram post itself? It feels like more than that because it doesn’t seem like a grand jury would indict him for JUST the Instagram post. I'm no fan of James Comey, I think he's a smug, self-righteous clown, but I'm also not sure there's enough evidence to actually convict him of wrongdoing. As Andy McCarthy explains well here, this is going to be a difficult case to prove. What's crazy is I'm sure the Trump admin must know that. So either they have more evidence we haven't seen yet, or they know Comey will eventually be acquitted but they don't care because this was just about trying to prove a point.
