What you are referring to is a "proffer" of evidence. If the Judge isn't sure if the jury should hear testimony, she sends the jury out, the Attorney puts the witness on the stand and asks the questions and she hears the objections and then rules. That way there is a record.

Judge Kaplan's thinking is to just have a private hearing today, get Sam's BS out of the way, set him straight, then let him officially testify tomorrow to a real jury…..he tends to ramble on about his personal stuff
