I was going to say that there is legal precedent for legally suing for this but then I realized you're in Canada and honestly I just feel bad for you.

ISP's have a monopoly on 99% of markets in the US as well. At maximum a customer has access to 4 ISP's, and that is less than 1% of any market. If someone lives in an apartment complex, the administration of said complex can have an exclusive contract with one ISP, and if a resident uses any other ISP, they can be in breach of contract with the complex & forced to move out. Now, in Canada, there's only a few ISP's, and those ISP's hold majority market, and they allow "white hat" sub-servicing just like in the USA. Think about Cell Service Providers, there's only 3 in the USA now. T-Mobile, AT&T, & Verizon. Then there's hundreds of "white-hat" sub-services like mint (tmobile), cricket (ATT), etc.etc. That's because there's a limited amount of space for towers, creating networks is extremely expensive, etcetc. It's even worse in Canada though, because there is substantially less "competition." Anyway, my advice @RickKackis is to do 3 things 1. Confirm you are only using ISP-Provided equipment--modem/router, nothing extra like a firewall or switch, or your own modem/router. If you are using your own equipment, you have to do some re-configuration. 1b. Go into your modem/routers admin page & find the Duplex/Negotiation settings, make sure none of those are changed. Even if it's set to Auto, that's wrong. Manually set it to 1000/full/auto-negotiation on, see if it improves, if not, go to 100/full/A-N on. If both fail-- 2. Contact the ISP & demand a PTD (Prove to demarc) dispatch. There will more than likely be a charge. 3. After the PTD is complete, if no fix is issued, then, request a RFC test to prove incorrect speeds. There's more troubleshooting that can happen on your end, but if you're using ISP-issued equipment, that's on them. Also, do NOT resign a contract with the same company for any reason. 100% not worth it & usually ends up costing you more money & tying you into services you just don't need & will never use. In regards to your ISP throttling you-- Maybe, or your modem is 'old'er. You don't have to resign a contract to get a new modem. A PTD Dispatch is to prove you aren't getting the correct service, and if proven, you get a new modem. If your ISP allows you to use your own Modem, do that. It's always faster to replace an 'old' modem on your own, but you will need them to whitelist & add the new modem on your account (typically the MAC address is what's needed by the ISP). Hopefully this helps my dude

Canadian telecommunications companies are actually evil. Complete Monopoly. Even going outside the big 3 lands you on a third party provider that utilizes the big 3 infrastructure, and they throttle third party providers when their customers are in high usage. Oh, they also gouge you $100+/month for the rate limited service.

Bro I literally just switched from Rogers to Telus. The rule in AB, every 2 years when your contract ends, switch to the other to get the new customer deal. Even the GIRL WHO SET ME UP with Telus, says she goes to Rogers for a month so she can get the new customer from Telus

Seems like a cease and desist from an attorney for them deliberately damaging your business may be in order - or contract on business grade ISP where they're obligated to provide you with specific speeds.

Might i suggest starlink? not sure of their support, but i use it and it's quite good, though i don't stream, so, take it with a grain of salt, but the down and uploads are good, even on their 100mb plan, the full plan is pretty good too i hear, though i cannot vouch for that one
