Today at committee, I asked Mélanie Joly whether she regrets voting to invoke the Emergencies Act, a move that has been ruled to have violated Canadians’ Charter of Rights and Freedoms. She refused to answer, saying it’s before the courts. Is the Liberal government now preparing to appeal this latest loss to the Supreme Court of Canada instead of owning up?

On the petition filed by Jamiat Ulama-e-Hind, the Supreme Court has put a stay on the actions being taken against madrasas, Madrasa-e-Islamia is a fundamental part of secularism in the country. Every minority living here has the freedom to impart religious education. These madrasas of Muslims were established for the country's independence, especially after 1866 and 1857. Today, there are attempts to shut the doors of these madrasas... We went to court against this. We are pleased that the court has recognized our legal rights... #Madarsas

🚨Breaking🚨 David Romlewski, a participant in Freedom Convoy, is seeking leave to appeal to the Supreme Court of Canada. This marks the first such attempt among those charged and arrested during what has been described as Canada’s largest peaceful demonstration. His case carries significant legal weight, as its outcome could impact all ongoing trials and appeals relating to Freedom Convoy 2022. Justice Mosley has already ruled that Justin Trudeau’s invocation of the Emergencies Act was unconstitutional - an illegal overreach of government power. This explains why, after hundreds of arrests, the Crown quietly dropped most of the "disobey order" charges. Rather than addressing the illegality of the order itself, prosecutors shifted their focus, aggressively pursuing bogus mischief charges under Section 430(1)(c) of the Criminal Code. The courts then convicted individuals as parties to an offense without identifying a principal offender. In effect, simply walking through downtown Ottawa when at the time of the demonstration could have been enough to land someone in jail for mischief. Insane, isn’t it? They also had a contingency plan… if a judge acquitted a Convoy participant of mischief, the Crown would appeal the decision until they secured a judge willing to overturn the acquittal. Romlewski experienced this firsthand - after his initial acquittal was overturned in Superior Court, his request for leave to appeal at the Ontario Court of Appeal was denied. He is now diligently preparing his factum to seek leave for appeal at the Supreme Court. At this stage, three of the nine Supreme Court judges will determine whether Romlewski’s case has the “national importance” required to proceed. Given the fact that this case essentially criminalize peaceful assembly, I think it’s fair to say that this effects all 40 million Canadians. Let’s hope that three of the nine justices will agree that this issue merits a full hearing. To all nine Supreme Court justices, Canada is counting on you to uphold justice and remain steadfast against political pressure. Public awareness is our greatest weapon, which is why this video is necessary. Freedom dies in the dark. An upgraded version of the Supreme Court’s e-filing platform was launched in May 2023. It offers a host of improved features that have made 24x7 filing of cases simpler, faster and convenient. Nearly 1,28,000 e-filings have been done so far, with a consistent rise in the share of e-filings compared to physical filings. E-filings are available in 25 states. They have recorded over 29 Lakh case filings. With the immense support of the Bar and the Bench, we were able to swiftly shift to virtual hearings during COVID. Even after the pandemic, hybrid hearings continue to be a feature of our courts. That is, any Indian lawyer sitting in any part of the country, or the world can argue before this Court through video conferencing. This has democratised access to the Supreme Court. It has opened the space for those who were unable to approach the Supreme Court due to physical distance..."
