District courts were established by Congress through the enactment of a federal statute, the Judiciary Act of 1789. District judges are not policy makers, that's the role of Congress. Article III, Section 2 of the Constitution limits courts to deciding “cases” or “controversies" put before them. District judges role is limited to interpreting and applying the laws within their jurisdiction, not make laws.
