You have a First Amendment right to record federal agents performing their duties in public, as long as you do not physically interfere. 2. You can use profanities against ICE. Profanity alone is protected speech under the First Amendment. Speech does not become illegal simply because it is offensive. It becomes unlawful only if it constitutes a true threat, incitement, or physical obstruction. What is illegal: 1. ICE cannot stop and detain people based on race. The Fourth Amendment prohibits unreasonable searches and seizures. The Fifth Amendment’s equal protection component prohibits racial profiling by federal officers. Detaining someone solely because they are Latino or appear to be Latino is unconstitutional. 2. ICE cannot point weapons to intimidate the public without an objectively reasonable belief of an immediate safety threat. Drawing or pointing firearms, pepper ball guns, or chemical spray are uses of force. Under the Supreme Court standard in Graham v. Connor, force must be “objectively reasonable” based on the totality of the circumstances. 🚨BREAKING: ICE agents are caught on camera threatening to violently assault a U.S. citizen for exercising their First Amendment rights, in Columbia Heights, Minnesota. In the video, an agent is saying, “I’m telling you right now, it’ll be the first time and last time that I tell you this… you continue to follow us, I’m going to fucking put hands on you, arrest you, and take you in.” The person filming responds calmly, “You can’t.” The agent screams back, “Test me. Please test me!” Then another agent jumps in with, “You aren’t just standing around and watching. You are impeding. You understand that concept?” Which makes one thing painfully clear… the agent does not understand that concept at all. Filming law enforcement in public, following them at a lawful distance, and observing their actions is constitutionally protected activity. It is not obstruction. It is not impeding. And it sure as hell is not grounds for arrest. But, threatening violence and detention because someone is recording you is retaliation for protected speech. That IS illegal. 🚨ICE agents are threatening to assault and illegally arrest U.S. citizens in Portland, Maine. In the video, a man is legally observing ICE activity in his own neighborhood. Agents walk up to his car window and ask, “Are you following us?” The man replies, “Yeah.” An agent immediately escalates and says, “What you are doing is called impeding federal law enforcement. It’s an 18 U.S.C. §111 charge. This is your first and only warning. If you continue to impede and follow us, you will be arrested.” The man then correctly responds, “Yeah, but I’m not impeding you.” Another agent jumps in and says,“You just openly admitted you were following us, so…” And again, the man correctly explains, “I am following you. I’m not impeding you. I’m observing you.” Which is a constitutionally protected right. The agent responds anyway, “It is impeding.” The man replies, “No, it’s actually not.” At that point, the agents become visibly angry that he knows the law and threaten him again, saying, “This is your one warning. The government cannot create the circumstances that make it impossible for you to leave, accuse you of “impeding” them, because you cannot leave, and then threaten to arrest you for not doing the impossible. Because that is coercion, and it’s illegal. And the most terrifying part is… this is how ICE agents are trained to operate. They create confusing, threatening situations where people don’t even know if they are being lawfully detained, if they are free to leave, or if they are about to be arrested for simply existing in the wrong place. And then the government expects people to calmly trust that everything they are doing is legal. Which is exactly why constitutional protections exist. Because “I’m a federal agent” is not a magic phrase that makes your constitutional rights disappear.
