Warrantless Entry from chief of police & Taser Arrest of former deputy Leads to Federal Civil Rights Lawsuit. ​ Buhl, Idaho resident and former deputy Eli Johnson was pulled over by officers for allegedly traveling 41 mph in a 25 mph zone. Johnson pulled directly into his own driveway. While the stopping officer stepped back to his patrol vehicle to retrieve a citation book, Johnson exited his car and walked toward his house. Despite being ordered to remain by his vehicle, Johnson went inside his home, arguing that officers had no proof of speeding and demanding to speak with a supervisor. ​When Buhl Police Chief Jeremy Engbaum arrived at the scene, Johnson opened his front door to speak with the chief while standing within the entry threshold of his home. Officers instructed him to step outside to receive the traffic ticket, warning that failing to do so constituted obstruction and delaying an officer. Johnson agreed to being issued the citation but said he was staying in the safety of his home. Showing an understanding of his rights, Johnson refused to step outside and requested to speak his attorney and wait for witnesses because he does not trust the chief. ​When Johnson attempted to close his front door, the chief physically blocked the threshold with his foot to prevent it from shutting. Later, there was an investigation by the Texas Rangers, which revealed that there were images of child pornography found on the hard drive of his computer. As an assistant district attorney, he would have known that each one of those images could have put him in prison for 10 years. Now, he made that decision... I feel terrible for his family. Obviously, it would be better had he had his day in court and hired a lawyer for a vigorous defense, as everybody deserves in this country. But that's not what he chose to do. There was no attempt to cover this up... We reported it as it happened, factually."

Officers informed him that the system indicated a charge related to the illegal possession of a firearm. ​The man strongly denied the charge, claiming: ​He had never been stopped or caught with a firearm. ​He did not own any firearms. ​He had an employee waiting outside who could drive his work truck home. ​The responding officers maintained a professional demeanor, explaining that while the warrant was confirmed in their system, a secondary verification process—including a fingerprint match—would be conducted at the county booking facility to ensure he was indeed the correct individual listed on the warrant. He wrote to them in October and enquired what was happening with the case. He has been told Nkabinde has written an Affidavit probably to withdraw his allegations. Raphesu has requested the Commission to assist him with an Investigator to make sure his matter doesn't land in wrong hands as he put it. He is going to open a criminal case against him. As he should. Currently he says he was removed from any cases relating to the Security Cluster. He is allocated cases from the Zondo Commission, Transnet etc. He says he just sits in his corner in that office. I want to thank the governor for standing up with us. I came to know through the media that SSP Nanak Singh had said that a magisterial inquiry had been set up, but the FIR could not be changed... Today, when everyone was standing up with me, all the politicians started calling me, but I didn't pick up a single call as this was not a political fight. They cannot say that we were under the influence of alcohol as it is there in the (medical) report of a government hospital... A police inspector told me that we cannot add the names of some police personnel in the FIR as they have been awarded as encounter specialists by the DIG and are about to be promoted. They said that police will do the needful but cannot name them in FIR ..." (21/03)
