No. The judge did not say the prosecution had no case. At the first hearing the magistrates accepted that the charge could be tried summarily, the defendant then elected Crown Court trial, and he was remanded in custody. “No case to answer” is a later submission after the prosecution evidence. It was not made, and it was not upheld.
