Natasha would destroy Dave Smith in a debate, as Douglas Murray did. But the online swarm would accuse Natasha, like Douglas, of the cardinal sin of having an English accent and declare Smith the winner.

Brilliant analysis and actually too polite when it comes to clowns like Dave Smith. His attempts to conflate the penal code with international laws of armed conflict are as ridiculous as trying to use real estate building codes to determine fault in a vehicular accident. In other words, there is no relevance whatsoever. Murder in the First Degree is a penal code term and one that is NOT universal. In New York State where I used to practice, it only applies to serial killers, mass shootings, and the premeditated murder of a government official, such as a judge or a law enforcement officer. In other states, Murder in the First Degree applies to the premeditated murder of any individual. People like Dave Smith remind me of an old comedian named Norm Crosby whose entire act was malapropisms, misusing words to comic effect. Here, Dave Smith is engaging in legal malapropisms.

The root question is legality versus morality. Just because the law is a certain way doesn't make it morally correct. That said, pretending like limited operations and allowing Hamas to continue under a new government election is going to lead to fewer deaths is out of touch with reality.

It might serve this discussion to — when appropriate — remind people that these discussions and frameworks matters go back at least to Augustine. Jus ad bellum is a moral theology of tragic necessity now codified: war is never good, but it can be less evil than inaction.
