If someone attacks a man who obviously has a gun he deserves whatever he gets.

This event took place in North Phoenix, March 24, 2021. Michael Montanarella (32) ignores a restraining order from going near Benjamin Backus (40) Montanarella wants Benjamin to scrap like a man, whilst having the gun pointed at him; that's when Michael found out. He later died in hospital. No charges were filed against Benjamin, as it was accurately deemed self-defense.

Knew he had a gun. Charged him anyway. Justified

You are not legally required to take a beating before defending yourself.

One of the reasons to have a gun Is so you don't have to do fisticuffs But if left with no choice, bang you 💀

Context: He had a restraining order against the aggressor, and the aggressor had a knife in his waistband - revealed to him after he took his shirt off This is why he was cleared of all charges Normally, it would be wrong to shoot if someone is unarmed Also look at the shooter’s narrow shoulders, Dude’s not a fighter

We need more of this and the world would be a better place. Once people start realizing that the risk is not worth the reward people will stop doing stupid, disrespectful things...For the most part, because there will always be stupid people.

That's plenty of backing up and warning. He defended himself.

A guy twice his size? If he kept backing up, he could trip or fall. If he turns and runs, the aggressor could catch up with him and use the gun against him. The aggressor has already shown intent to commit bodily harm. One shot, center mass, ended the threat. Perfect self-defense case.

@fightsonlyy That was textbook self defense. The violent aggressor learned a difficult lesson that evening.

The part of the story that is not shown is that the other guy has been stalking the gun owner guy for quite some time. This video happened when the stalker, who was lying in wait, jumped out as the other guy was leaving his house to go to work at like 4 am. This was an ongoing problem. This video has been around a while. All, I know is that if you are hiding in the early morning hours and pop up on someone you have been harassing, expect to get shot.

That little fuckwit had every chance in the world to avoid being shot. You'd think the least he could've done was to not cry like a stuck pig.

You gotta be a real dumbass to try to physically attack someone with a gun like this.

Old video. He shot a stalker and was not charged. I wish he'd have targeted the pelvic girdle.

Context: He knew the guy and had a restraining order out against him. It was a long-time "friend" and they had a falling out. The shot wasn't meant to be lethal but sadly was. The idiot was drunk and definitely deserved to be put on his ass, not a death sentence, though. Did the guy with the gun go too far? Yeah, sure, maybe a little, but better than not going far enough. He did his duty and saved his skin; that's the most you can ask of any man.

I am old enough to no longer enjoy fist fights. He did as I will. I am not going to fight, I will just use my wireless hole puncher and go back to whatever I was doing.

I'm trying to understand why, when an individual is holding a loaded handgun and telling them to stand down, someone would decide to physically attack that individual. I think the shooter did the human gene pool a favor.

I'm familiar with this incident, Active Self Protection (ASP) did a great breakdown of it. Michael Montanarella, the aggressor who died was 1. Violating a restraining order. 2. Ambushed the Homeowner on the Homeowner's property. 3. WAS ARMED with a combat folding knife. It's clear he wanted to attack and murder the Homeowner. The much longer video shows Montanarella only fold his knife and clip it to his shorts after he realized his would-be victim was ready for him and when at GUNPOINT he decided on the "fight me like a man" tactic. His COMBAT FOLDER was clipped to his belt, and it appears he wanted the "fight me" proximity to either disarm or slash the other guy. Who wisely shot him.

He was defending himself but, the court and the lawyers would argue. The other guy didn't pose a deadly threat by trying to assault him. Pretext would also matter as to why this confrontation started and if the guy with the gun had anything to do with antagonizing it as well as all the other evidence there may be. Moral of the story is have better survival Instincts and don't try to punch a guy who has a gun pointed at you.

He only fired one shot and this guy was coming at him after several warnings so I think he done a wonderful job of demonstrating self defense. Any judge would be incompetent to think otherwise
