Third, and most importantly, the Qur’an gives a clear principle for marriageable capacity in Surah An-Nisa 4:6: “Test the orphans until they reach marriageable age; then if you perceive sound judgment in them, deliver their property to them.” This verse combines two conditions: reaching marriageable age and possessing rushd — mental maturity, sound judgment, and the ability to manage responsibility. This is crucial. If the Qur’an requires maturity and sound judgment even before giving a person control over property, then marriage — which the Qur’an calls a “solemn, weighty covenant” / mithaqan ghaliza in Surah An-Nisa 4:21 — cannot be reduced to a contract imposed on a child who lacks understanding, consent, and responsibility. The Qur’an also rejects coercion in marital matters. Surah An-Nisa 4:19 says: “Do not inherit women against their will.” Surah Al-Baqarah 2:232 speaks of marriage taking place when the parties agree with one another in a proper manner. These verses show that marriage in the Qur’an is not a forced arrangement over a powerless person, but a moral contract involving agency, dignity, and consent. The Qur’an also commands that harm must not be used in marital relations: “Do not retain them to harm them and transgress.” (Al-Baqarah 2:231) A marriage that harms a child physically, psychologically, or socially contradicts this Qur’anic principle. Therefore, Surah At-Talaq 65:4 cannot be isolated from the rest of the Qur’an and used as a license for child marriage. The Qur’an’s internal logic points in the opposite direction: marriage requires maturity, sound judgment, consent, dignity, and protection from harm. In short, the Qur’an does not establish child marriage. It establishes a framework of responsible marriage between people who are capable of understanding and carrying the weight of the covenant.
