In 2022, the Obama appointee issued a scathing rebuke of her fellow justices for politicizing the court and allowing nationwide injunctions against Biden. She said: “When people see [the court] as extensions of the political process, when people see them as trying to impose personal preferences on a society, irrespective of the law, that's when there's a problem and that's when there ought to be a problem,” Kagan said. Rogue justices at the lower court level have issued DOZENS of nationwide injunctions, despite President Donald Trump having legitimate Article II powers to govern on executive branch, national security, and foreign policy matters. But Justice Elena Kagan on Friday dissented on a Supreme Court case that narrowed lower court judges' authority to issue nationwide injunctions.
