In 2022, the Obama appointee issued a scathing rebuke of her fellow justices for politicizing the court and allowing nationwide injunctions against Biden. She said: “When people see [the court] as extensions of the political process, when people see them as trying to impose personal preferences on a society, irrespective of the law, that's when there's a problem and that's when there ought to be a problem,” Kagan said. If it's a Democrat official or a member of its identity politics coalition, anything goes. If it's a Trump official or a conservative, then there are no such things as constitutional rights.
