Why did they let him hand his mobile phone to a friend? Surely, if he’s arrested in possession of a mobile phone it would be held as evidence. No, you cannot typically hand your mobile phone to another person during an arrest. Police officers have the legal authority to prevent you from passing items to bystanders, and attempting to do so can be treated as obstructing an officer or concealing and destroying evidence.
