HE PROTECTED 54,000 DOCTORS. THE @NHS PROTECTED ITSELF. In January 2014, Dr Chris Day (Dr Chris Day) was working overnight in the intensive care unit at Queen Elizabeth Hospital in Woolwich. Two locum doctors didn't show up. The unit was running at double the patient load the national guidelines... allow. He raised the alarm. He reported unsafe staffing. He linked the situation to two patient deaths. That's what the NHS calls a whistleblower. What followed was eight years of litigation, a legal battle all the way to the Court of Appeal, and over £700,000 of public money spent by Health Education England (NHS England Workforce, Training and Education) and Lewisham and Greenwich NHS Trust (Lewisham and Greenwich NHS Trust) trying to stop his case being heard at all. Here's the really elegant bit. HEE's opening legal argument wasn't that they'd done nothing wrong. It was that whistleblowing law simply didn't apply to them, because they didn't directly employ junior doctors. They were just the organisation that controlled the career progression of every single one of England's 54,000 junior doctors. Totally different thing. Dr Day fought that argument to the Court of Appeal and won. The law was clarified. All 54,000 junior doctors below consultant grade in England now have statutory whistleblowing protection. One man, crowdfunding against three QCs, changed employment law for an entire profession. No formal apology from the NHS. No reinstatement. No path back to a consultant career. He has worked as a locum A&E doctor ever since, doing overnight shifts while his opponents collected salaries, pensions, and the occasional glowing tribute to NHS transparency. During the 2022 tribunal hearing, the communications director at Lewisham and Greenwich NHS Trust deleted up to 90,000 emails. The director whose entire NHS email archive was also deleted during live litigation happened to be the instructing legal client in the case. The tribunal described the conduct as extraordinary. Nobody was prosecuted. The trust issued a partial apology about a press release. The system did exactly what it always does. It absorbed the cost, deflected accountability, and waited for the man it destroyed to run out of money or energy. He hasn't. My views having Whistleblown in 2 separate roles where I witnessed vulnerable children who DIED and suffer extreme harm, I only went thru 1 Employment Tribunal. It was a complete farce. I was told my application was out of date, having been assured that it wasn't. I was told there was no public interest... vulnerable children, aged under 18 are covered by the Children's Act. Their placement was paid by the Local Authority. Complete BS. I didn't meet the Barrister representing me before the hearing, if I had I would not have agreed to him, he could barely string a sentence together! I didn't receive the bundle until the night before the hearing, no opportunity to review it, many documents missing. My solicitor told me that the bundle had to be agreed with the other party! More BS. My solicitor failed to call any witnesses, he had statements that completely contradicted those of my employer. It was very apparent that my solicitor didn't represent me. He exploited me His lack of knowledge of Safeguarding and in the public interest was unbelievable In my next role I made a decision that the ET route was not fit for purpose The Whistleblower Policy clearly identified that a Whistleblower could disclose to the Media I made sure I documented and recorded everything Gagging Orders can NOT be used for Whistleblowers, to cover up crimes or where a statutory legal duty exists Money was never my motive I witnessed and experienced a number of children who DIED and Local Authorities LIED to cover up their failures and crimes We need to stop thinking that the ET process is fit for purpose, its not Social Media is a very good source to use to raise our concerns in the public interest when PIDA doesn't work We have Tribunals whose one job is to protect the brand, where is the public interest in that My employers - both of them - bullied and abused me until I considered suicide as a means to escape their abuse The same issues and abuse used on the vulnerable children I worked with They created fraudulent data to cover up their crimes and their abuse In my case the Director of Law and Governance abused me until I considered suicide and then created the data to cover up their crimes, just as they did with the vulnerable children in the home where I worked. The Director of Law and Governance is also Coroner for Oxfordshire Imagine a Coroner who acts in such a vile way Remember Dr David Kelly.... another Oxfordshire resident whose death was recorded as suicide by the Coroner and to avoid being challenged his medical records were sealed for 70 years How many more 'suicides' are arranged and covered up relating to Whistleblowers After Ruth Perry's death there was some acknowledgement of the part Ofsted played Where was my Article 2 Right to Life Tortured by the State and labelled as mentally ill...... Avoidable deaths..... There are plenty in Oxfordshire but the State marks its own homework within Serious Case Reviews

Dr Chris Day, it is people like you that the country needs. Diligent and loyal to why you became a doctor. An amazing example of courage. Ofcourse the authorities don’t see or quantify your sacrifice. Public money spent on something that could have been improved in a meeting rather than court to cover up short comings. This will only be reversed, when politicians stop worshipping at the feet of the @NHS .. I come from an Airline background.. from the outset - 80 years ago - the industry ✈️ agreed to be open, transparent and face up to the causes of all air accidents & incidents.. Information is shared between the countries, airlines, manufacturers and all of the international Organisations which cover the industry such as the national CAA’s, ICAO, IATA etc … There is a no fault approach which encourages an openness to get to the source of the problem. It is only on the conclusion by the air accident investigation authorities, that legal proceedings may be taken if appropriate.. So the question is …why won’t the Health Secretary take on board these points ? To put so many Doctors and other NHS staff through hell in this way is wholly unacceptable.. Hopefully one day a politician will emerge who will tackle this head on.. Only then will innocent staff, who’ve actually done their job be listened to and not used as scapegoats to a system which is fatally flawed…

It’s hard to stand up. I’ve done it and you get ten tons of crap thrown at u by high management. U make yourself hugely unpopular but when it’s about the absolute safety (or lack thereof) of patients, you have to stand. It’s part of our professionalism. I came onto the worst set unimaginable for a night shift in an A&E. Where they’d put people was ludicrously dangerous to patients and staff - would’ve left us swinging in the wind if a patient was harmed by their choices. ‘You’ll accept responsibility for this of course’ they said. Not a sodding chance was my reply. They patients weren’t even within the department. No call bells, no emergency equipment, nothing. It was ludicrously dangerous. So they were refused and we started a grievance procedure. A line has to be drawn. That’s part of the job, even tho it makes us hugely unpopular and right in the firing line. Which it absolutely should not. Wasn’t the last time this happened either tho the next one was even worse. Talk about a witch hunt…. #whistleblowing #patientsafety #staffsafety #NHS

Did he contact his on call consultant(s) who have ultimate clinical responsibility? Did they attend the hospital to ensure that his concerns were addressed and reassured? Did they disagree with his concerns? Did they dismiss the published guidelines of the ICS/FICM? The background narrative in many of these situations ignores the responsibilities of on-call consultants who frequently fail to listen to concerns raised by trainees🧐

They’re always at it the NHS, friend of mine sued them over the neglect which led to the death of his wife. They lost her test results which showed cancer! They said the pain was all in her head a year later before eventually finding the tumour. Too late by then. Disgusting cover up behaviour followed. No surprises there. 🤬
