Today we witnessed yet another escalation in this administration’s war on immigrant families. We saw mothers torn from their children, as they were detained until false pretenses. We saw community members assaulted by ICE agents while exercising their right to protest. These actions are an abuse of power, and we will not stand for the fear and instability they are causing to our communities. They want to divide us through fear and intimidation, but today, we chose solidarity. 🚨This is terrifying. ICE illegally broke into a home in Burnsville, Minnesota, without a warrant, searched the entire residence, broke down doors, and detained U.S. citizens. A legal observer is sitting in a car behind them, not violating the law, just observing. The homeowner comes out and tells them to leave, because they are on private property. The man they’re trying to detain is saying the same thing… you’re on private property… get out. Instead of backing off… an agent grabs him around the waist, trying to tackle the man. The man breaks free, crawling to the door, and goes inside the house. At that point, this should’ve been over. Because under the Constitution, entering a home without a warrant is one of the clearest lines law enforcement are not allowed to cross. But, they cross it anyway. One agent grabs his foot as he’s going in… and then both agents follow him inside the home, while the homeowner is actively telling them to get out. Over and over. This is exactly what the Supreme Court ruled against in Payton v. New York… law enforcement cannot enter a home to make an arrest without a warrant. And in Lange v. California… they made it clear you don’t get to chase someone into their home, for a non-serious offense, and call it “hot pursuit.” They were told to leave private property… and didn’t. Agents walk up to his car window and ask, “Are you following us?” The man replies, “Yeah.” An agent immediately escalates and says, “What you are doing is called impeding federal law enforcement. It’s an 18 U.S.C. §111 charge. This is your first and only warning. If you continue to impede and follow us, you will be arrested.” The man then correctly responds, “Yeah, but I’m not impeding you.” Another agent jumps in and says,“You just openly admitted you were following us, so…” And again, the man correctly explains, “I am following you. I’m not impeding you. I’m observing you.” Which is a constitutionally protected right. Mamdani: And I think what we've seen under this current administration here in New York City is an unwillingness to stand up for the laws we already have here. We have sanctuary city policies, which used to be defended by Democrats and Republicans alike. These are policies that do not allow ice admission into schools, into hospitals, into any city property or properties of city contractors unless they can show a judicial warrant signed by a judge. And what we know is, time and time again, the videos we're watching, they're not videos of warrants being shown. They are videos of brutal intimidation. And it is time to have a mayor of the city who recognizes this risk is a present day one, and will stand up for each and every one of the 3 million immigrants who call the city home. I'm one of them, and an understanding that an attack on any New Yorker is an attack on the entirety of the city.
