It isn't even a gray area. The Constitution explicitly allows the President to use the military to destroy pirates at his discretion. Article I, Section 8, Clause 10 to "define and punish Piracies and Felonies committed on the high Seas." Article II, Section 2, allows the Commander in Chief to direct military forces—including the Navy—to combat piracy threats to American lives, property, or commerce on the high seas.
