In simple terms, this is a new Kenyan law (officially the Assumption of the Office of President and Transition of Executive Authority Act, 2025) that acts like a "rulebook" for handing over power from one president to the next. It spells out exactly how the swearing-in ceremony happens, who does what during the handover, and how to avoid chaos if the outgoing president can't show up. Most important is that the person announced as president by IEBC immediately has presidential powers and authority before swearing in. Kenya already had some rules on this from the 2010 Constitution (Article 141, which says the president-elect takes office by swearing an oath) and an older law called the Assumption of the Office of President Act of 2012. That 2012 law focused mostly on the ceremony—like handing over a symbolic sword (for the president's role as military commander) and a copy of the Constitution from the outgoing leader. When being sworn in, the power thirsty William Samoei Ruto, PhD Felt and accused the outgoing side of dragging their feet—not providing full briefings, security details, or cooperation. It felt messy and risked instability according to them. To fix this, the government started working on an upgrade in late 2024.
