If it is true that the hospital has detained these young mothers and their newborns as alleged simply because they cannot pay cash for maternal services then it is illegal, unconstitutional and inhumane. This amounts to unlawful confinement and a gross violation of the dignity of our mothers. The following county officials MUST urgently investigate this matter and act immediately: • H.E. Dr. Paul Nyongesa Otuoma, Governor of Busia County • The County Executive Committee Member for Health & Sanitation, H.E Hon. A wrongful impeachment is not only a legal issue but a scar that follows a person into every political contest, appointment and general perception. In a resounding affirmation of the rule of law, the Court of Appeal rendered its decision in Kisumu COA CA No. 008 of 2020 quashing the unlawful impeachment of my friend, George Onyango Oloo whom I represented at the Court of Appeal. Hon. Oloo was the Speaker of the Kisumu County Assembly until he wasn’t, following an impeachment process that came fast and furiously; completed in an unprecedented three hours! Three hours to prepare a defense; three hours to appear before the House for the debate and the same three hours to fight for his political career. The matter went before the ELRC contesting the manner in which the County Assembly of Kisumu conducted the impeachment proceedings and instead of examining the glaring procedural injustice, trial Court focused on the substance of the allegations in the motion for impeachment before the Assembly, reasoning that those were very serious allegations they justified the impeachment. On Appeal, I argued one simple irrefutable principle; the right to fair hearing is absolute, Art 25. That the concept of fairness plays a major role in the enjoyment of this particular fundamental right which extends beyond mere listening to parties present their case(s). The Court of Appeal agreed with us, set aside the impeachment for being fundamentally unconstitutional and awarded compensation for the unlawful impeachment. More significantly, the decision released Hon. George Onyango Oloo from the political and reputational stigma of unlawful impeachment. That to me did more than rectify a legal wrong.
