However, Azcuna points out that the ICC adheres to the “Male captus bene detentus” principle, which means that “even if the arrest is illegal, the detention can still be legal” based on the gravity of offense. Padilla said Senate President Win Gatchalian should lead the proceedings in line with the Constitution. However, the 1987 Constitution only explicitly states that the chief justice shall preside when the president is on trial, and does not make a similar requirement for other positions. In a June 3 session, the Senate approved a resolution allowing the chamber to elect a presiding officer. “Dapat yung majority ine-encourage nila dapat si SP Win… Para sa akin nadedegrade yung tao e,” Padilla said. Charles Kanjama: Normally, when a right to fair trial or fair hearing is infringed, you invalidate the hearing, you set it aside, or you order a new trial. This is the first time in my experience as a lawyer that the court has made a clear finding that the right to a fair trial was substantively violated but has failed to reverse the underlying outcome of that fair trial. The court said our hands are tied because impeachment is final; we cannot undo it. The court at that time said we can overturn the outcome of the impeachment, but today it has said once the impeachment is done, it cannot be overturned. There is a lot of inconsistency in the decision of the court #CitizenMondayReport
