Man did the right thing. Get verbal confirmation that refusing ID will result in arrest. Once confirmation is recorded, comply. The reason this is important to do is because police often "ask" for ID for fishing purposes when in fact it's a scenario whereby you are not obligated to show ID. They present their "asking" for ID in a demanding manner so as to try and intimidate you into complying and forfeiting your other rights.

You have to have a reasonable articulable suspicion that the person is committing or has committed a crime, without which, you are not required to provide ID. It's not a crime to film, and it's not a crime to look. You cannot criminalize a 1st Amendment protected activity.

Has been a thing where I live since the 90s. I know someone who got caught for it. Their car was impounded for 30 days, their license suspended and were issued a misdemeanor citation. Was a life altering event for them as they could no longer pass a background check and had to pay nearly DUI levels for insurance for years after. Not to mention the thousands in fines, impound fees and court costs.

The man was filming an illegal street racing event & issued a citation in California for being a spectator. He claimed to be uninvolved in the racing, police treated his presence as spectating & issued citation. Legally served - CA has a law against spectating illegal events.

It is against municipal ordinance in some locale to "spectate" illegal activities such as street racing.
