Bully cop wanted to flex his muscle on an attorney ends up with feds involved and $175,000 settlement. We are in Louisville, Kentucky, 64-year-old attorney Douglas Miller was pulled over by LMPD Officer Mark Batson for allegedly speeding at 76 in a 55 mph zone. What should have been a standard roadside encounter spiraled into excessive force within minutes. ​After passing field sobriety tests, Officer Batson asked Miller to submit to a portable breathalyzer. When Miller briefly hesitated to ask questions before agreeing to blow, Batson escalated immediately—grabbing Miller and eventually getting him on thy ground to cuff. ​Body camera footage caught Batson assaulting Miller whom was already pinned and handcuffed. Meanwhile in his report he filled it with lies and omitted the tactics he used to restrain Miller. ​The aftermath was brutal. Miller blew a 0.064 BAC at the jail and tested at 0.067 on a blood draw—well below Kentucky's 0.08 legal limit. Miller was left with visible injuries as a result of the encounter. Despite this, he was hit with charges of DUI, resisting arrest, and criminal mischief alongside the speeding infraction. ​Rather than holding the officers accountable, LMPD closed ranks. Incident reports omitted all mentions of the techniques used to restrain Miller, claiming Miller actively resisted. LMPD's Professional Standards Unit fully exonerated both Batson and Best of any policy violations, issuing zero internal discipline. ​The case caught the attention of the U.S. Department of Justice during its pattern-or-practice investigation into LMPD following the death of Breonna Taylor. The DOJ specifically highlighted Miller’s arrest as a textbook example of unconstitutional neck restraints and superficial internal reviews. ​All bogus criminal charges against Miller were ultimately dismissed when he pled guilty to the initial speeding violation. The city of Louisville agreed to a $175,000 settlement in Miller’s federal civil rights lawsuit, while LMPD entered into a comprehensive, federally enforceable consent decree. This is another example of an officer's ego getting damaged because he didn't like that Miller passed his sobriety testing and pointed it out to him. In the end Miller was under the legal limit when tested. It's scary how often you see these departments circle the wagons to protect bad cops.
