There is a committee of three judges investigating the matter, but investigation is domain of the Executive. Investigation is not the domain of Judiciary. Is the committee under the Constitution of India? No. Is this committee of three judges having any sanction under any law emanating from Parliament ? No. A committee can at most make a recommendation. The kind of mechanism we have for judges, the only action that can be taken is by the Parliament. A month has passed. An investigation requires speed, expedition and preservation of incriminating material. As a citizen of the country and holding position which I do, I am concerned. Are we not diluting rule of law? Are we not answerable to 'We the People' who gave us the Constitution? I would strongly urge everyone concerned to examine this as a test case. What legitimacy and jurisdictional authority does this committee possess? Can we have separate law made by a category and the law made by that category, dehors Constitution, dehors Parliament? The committee report, according to me, inherently lacks legal standing. #RajyaSabha

[WATCH] IMPEACHMENT COMMITTEE CHAIR. If Mmusi wants to chair the committee he must put his ambitions forward and not create his own rules. There is no rule that says the ANC is excluded from putting forth a candidate to chair the committee. We are not going into the impeachment process to defend, we are going into it guided by the ruling of the constitutional court and follow all matters step by step as expected of us. Even in the Ad Hoc Committee we have acted without fear or favour, even against our own. Maimane must not create rules that are non existent and he has ambitions to chair the committee and we will not support it. We have had an Ad Hoc Committee chair by Cde Soviet who is an ANC member, it was fair and he was unbiased even against his fellow members who appeared. So this allegation that the ANC will defend its President is unfounded and the example of the Ad hoc Committee proves that. NO ONE is saying that she was disciplined by the Senate Ethics Committee - so she is denying a claim that no one has made. That’s because the Senate Ethics Committee has not disciplined one of their own in many, many years. Instead, when it finds wrongdoing, the Ethics Committee usually makes the senators fix the problem and promise to never do it again! Here are the right questions: If this ethics investigation was politically motivated as you claim, why not release your correspondence with the Senate Ethics Committee to prove that the committee investigated and found nothing? If you refuse to release correspondence with the Senate Ethics Committee, why should votes not assume that you are hiding something? @ There was an ethics complaint against you last year for voting for legislation from which you could profit. Will you release any correspondence with the Senate Ethics Committee about that complaint? There was an ethics complaint against you in 2021 for using your position to help an aide get out of a traffic ticket.
