Law enforcement uses ‘reasonable suspicion’ to make arrests, as protected under the Fourth Amendment to the U.S. Constitution. The Supreme Court has already vindicated us on this position. A person’s immigration status makes them a target for enforcement, not their skin color, race or ethnicity. Tricia McLaughlin

So explain this guy getting detained because of his accent

You don't get to rewrite the Constitution just because it suits your Stasi agents, communist. Reasonable suspicion is NOT protected under the Fourth Amendment. You must have PROBABLE CAUSE.

Great 👍 We have MORE than "reasonable suspicion" that Trump is a pedophile, Tom Homan took $50k, & your banging Cory Lewandowski & funneling money to your friends. Start making arrests!!!

This is basic stuff. How are you STILL getting it wrong. You cannot arrest someone based on reasonable suspicion.

The Supreme Court said reasonable suspicion was needed to make a stop — not to make an arrest.

How does a DHS agent develop this reasonable suspicion, Tricia?

I mean, this one, the agent literally says, “how do I know you are a U.S. citizen?” So, that’s definitely targeting based on his skin color.

Reasonable suspicion in not racial profiling. And you aren’t allowed to go to people’s houses and assault them for refusing to give you their ID. You are human trafficking people.

A government that disregards its own rules when they become inconvenient has confessed that law is not its master but its instrument. Such a power is not administering justice; it is exercising force. For law, to be law, it must bind those who wield it before it binds those who are subjected to it. Whenever government officials alter meaning, suspend limits, or invent authority after the fact, they are not acting under law, but above it. That would be tyranny. A power that reserves to itself the privilege of rewriting the rules as it pleases is not a government of laws, but a government of men who are answerable to nothing but its own will..

Probable cause is the minimum required for arrest. Reasonable suspicion -- a lower standard of proof -- is the minimum required for a Terry stop. Probable cause is a higher standard and absolutely required for an arrest.

Would love to hear the “reasonable suspicion” used when stopping a random woman walking down the sidewalk in her own neighborhood.

Maybe you should read The Fourth Amendment. “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

This is also not reasonable suspicion… this is human trafficking of a TEENAGER.

You guys literally argued in court for the ability to use skin color and language as grounds for detaining people

@TnVolFan88

We were all a little curious what it would be like to have a thin-skinned pedo racist narcissistic senile geriatric psychopath criminal for a president. It’s going exactly how we’ve imagined it. Good job America. Fuck you MAGA.

We support you but one correction. You use reasonable suspicion to detain and probable cause to arrest.

This is unfortunate for you…

What “reasonable suspicion” did you use when someone was using the bathroom?

25 days. She was born in the US. She is a US citizen and you still held her for 25 days. Sent her to 4 different states.

This is not “reasonable suspicion”… this is human trafficking.

Probable cause and reasonable suspicion are not the same thing. Asking for ID from someone who has done nothing wrong is you have no reason to assume they have is an unreasonable search and seizure. Protesting in manners you don't like does not constitute probable cause. The courts have also ruled that things like DUI checkpoints are unconstitutional for the same reasons.

I guess the white nationalist guy who runs this account took the day off and was replaced by the world’s worst law student?

Hey @DHSgov, @KristiNoem, @TriciaOhio, and all you other idiots: the Fourth Amendment does NOT protect law enforcement's ability to make arrests based on "reasonable suspicion." The Fourth Amendment protects WE THE PEOPLE from unreasonable searches & seizures by the government (that's YOU). I'm so sick of people acting like this administration is even remotely conservative or constitutional. This is such a blatant misunderstanding of the Constitution but really proves where their mindset is at: the Constitution is simply an inconvenience — invoked only when it shields THEM, not us. Wake up.

Abolish ICE. You have inadequate training, incompetent leadership, and you lie about everything all of the time. Face it: Obama’s administration deported more people than you, and they did it the right way.

Love the community note 😂 Let's try not to erase our constitutional rights, yea?

This is an *indisputably false* statement of very well-established law by an official federal government account Pursuant to the US Constitution, *all* arrests require probable cause, not reasonable suspicion

When you idiots make shit up, anything is possible. The constitution is dead.

We should just deport ICE to Greenland

They will always use the race card when their crimes are being exposed! They do it all the time! That is Soros’ playbook. He says it opening he plans to destroy America from inside by igniting race wars! I.E - he funds Antifa and BLM. Remember the burning down and looting of our communities in 2020 the Summer of Love?!

BULLSHIT. None of you assholes have “reasonable suspicion” to do what you’re doing. But we’ve got more than a reasonable suspicion that all of you are the secret police of a totalitarian regime.

Not being able to speak English is itself probable cause.
