Mufti Saif al-'Asri on the fatwa by some Hanafis that allows interest (riba) based transactions in non-Muslim lands. People are using this opinion to claim that Muslims taking out interest-based mortgages is permissible. Question: Is it permissible to conduct interest (riba) based transactions in Western countries? Mufti Saif al-'Asri: This question is very important, especially if the intention of this Muslim, who lives in a Muslim country, is to introduce them to Islam and its way of life, and to be an exemplary person that people imitate. So, if when he comes to a non-Muslim country, he says: "There's an opinion that the Hanafis have which considers it permissible to conduct otherwise impermissible transactions in non-Muslim lands. So, it's permissible for me to sell pigs to them and it's permissible for me to engage in interest (riba) based transactions with them. Some Hanafis make the condition that he is the one receiving the interest and not giving it, meaning he's the one receiving the benefits (of the interest based transaction) and he's not benefiting the one he's conducting a transaction with, and so forth. This is an opinion, an opinion that exists. We can't wipe away this jurisprudential opinion. And it has its evidence. However, the vast majority of scholars, and it's even an opinion within the Hanafi school itself, are of the view that it is haram for a Muslim to conduct an impermissible transaction with a non-Muslim. It is not permissible for him (a Muslim) to conduct an interest based transaction with him (Non-Muslim), nor is it permissible to sell or buy alcohol from him, nor is it permissible to sell him pork, and so on and so forth. None of that is permissible. And this opinion is the opinion of the vast majority of scholars. It's the opinion that allows you as a Muslim to be proud of your religion in front of others. It allows you to proudly showcase the distinguishing features of Islam and take honor in the religion that you ascribe to. On the other hand, if you're going to take legal dispensations and conduct transactions based on these things, how are you going to be a caller to this religion? Through your character? The way you speak? Your actions? How? How are people going to look at you? If they say: "Islam prohibits pork; however, masha'Allah, this Muslim at the store sells pork." I mean, what will make you different from other people? A Muslim must not conduct impermissible transactions, whether it's interest or other than it in Western countries.

For the sun does not cease to rise because a man refuses to look upon it. And God does not cease to reign because His children wander from His embrace. . If you ever find yourself in doubt, remember this: the defiance of man is but a whisper against the roar of eternity. The glory of God is as unyielding as the mountains and as boundless as the sea. It is woven into the sunrise, the turning of the seasons, the song of creation itself. You cannot destroy it. You cannot unmake it. You can only choose whether to bask in its light or to linger in the shadows. . Take heart, then and do not be swayed by the noise of those who mock the divine. For their words are as fleeting as the wind but the glory of God is eternal. Acknowledge Him not because He needs your praise but because your soul needs His light. Worship Him not as a favor to the Almighty but as a declaration that you see, that you understand, that you are humbled by the grandeur of the One who crafted all that is and all that ever will be. . God’s glory is not diminished by denial, nor is it amplified by praise. But you, my friend—you are elevated when you bow before the Eternal. You are strengthened when you trust in the One who holds the stars in place. And you are transformed when you abandon the shadows of pride and step into the radiance of His truth. . Remember this always: the lunatic may scrawl his defiance but he cannot extinguish the light. The doubter may deny the sun but he cannot halt its rise. And the world may rage against the King of Kings but it cannot dethrone Him. Stand firm, therefore, as one who walks in the light of God. NEW: Important Advice to Maḏhab Fanatics by Shaykh Sulaymān al-Ruḥaylī 1. We study the fiqh that was known to the Companions, and known to the Tābiʿīn, and known to the Imāms. 2. We study fiqh that is connected to evidence and built upon proof. This is the legitimate Sharʿī fiqh—the fiqh whose practitioner is praised, whose action is commended, and which is true understanding of the religion of Allāh. 3. As for binding people to a single Maḏhab from which they may not depart, and obligating them to adhere to everything stated within it, then this is an innovation—an innovation that did not exist in the time of the Companions. Rather, the Companions used to forbid it. It did not exist in the time of the Tābiʿīn, nor in the time of the four Imāms. In fact, the four Imāms were united upon forbidding the sanctification of people’s statements; rather, matters are to be examined in light of their evidence. 4. It is authentically reported from the four Imāms that they said: "If the Ḥadīth is authentic, then it is my Maḏhab." 5. Evidence for this is that the students who were raised upon the teachings of the four Imāms did not sanctify the Imām's opinion; rather, they would sometimes differ with the Imām's opinion. Anyone with even minimal exposure to the books of jurisprudence will find this clear and evident. 6. The four Imāms did not teach their students to sanctify their opinions. Rather, they taught them to look to the evidence and to support the evidence. Whoever examines the books of the Maḏhabs will find this plainly evident. 7. If you look into the books of the Ḥanafīs, you will find that Muḥammad ibn al-Ḥasan sometimes differed with Abū Ḥanīfah, and that Abū Yusuf sometimes differed, and that Zufar sometimes differed. 8. If you look at the statements of ibn al-ʿArabī al-Malikī, and Ibn ʿAbd al-Barr, you will find this clearly evident. This is how Imām Mālik nurtured his students. Imām Mālik would sometimes not hold a particular view, but when a Ḥadīth reached him, he deemed it sound and adopted it. The same applies to al-Shāfiʿī when you look at his students, and likewise Imām Aḥmad. 9. The strict obligation to adhere to Maḏhabs in such a way that one may not depart from them only arose among the later scholars. We, in reality, do not condemn following a Maḏhab or affiliating oneself with a Maḏhab —this is a permissible matter according to what is well known among the scholars. Rather, what is blameworthy is fanaticism to Maḏhabs, and tying fiqh to Maḏhabs in such a way that one does not go beyond them and does not consider the evidence at all. Instead, issues are decided solely by the statements of the scholars of the Maḏhabs. 10. Following a Maḏhab, according to the scholars, if taken as a path to fiqh and not as fiqh itself, they do not condemn it. But if it is taken as the fiqh itself, and one restricts himself to it—indeed, even casting doubt upon what people know of rulings established upon evidence—then this is not permissible, and it is not the praiseworthy fiqh.

It is well known that Usāmah Ibn Lādin respected and quoted Shaykh Muhammad Ibn ‘Abdil-Wahhāb and Najdī Da’wah scholars in his speeches. But what most people don’t know, is that he was not a blind-follower of Shaykh Muhammad Ibn ‘Abdil-Wahhāb and the Najdī scholars. This is important to notice, when it is also well-established that ISIS views itself as a reincarnation of the Najdī Da’wah. This is clear in their writings, in how they view themselves. NOTE: I am not saying they are the true followers of the Najdī Da’wah - but I am saying that this is what they openly profess themselves to be. In this video clip, we highlight one of the major differences between Usāmah Ibn Lādin and the Najdī Movement, is the takfīr of the Ottoman Empire. But before that: We find one of the Najdī scholars was asked about the Ottoman Empire: “(Question) regarding those who do not consider the (Ottoman) State to be kuffār, and those who support them against the Muslims, and chooses loyalty to them and that they are obliged to wage Jihād alongside them; and (what about) the other different opinion, asserting that the (Ottoman) State and those who support them are rebels (bughāt)…? (The Najdī scholar) answered: Whoever does not do takfīr of the (Ottoman) State, and does not distinguish between them and the Muslim rebels - does not understand the meaning of “Lā Ilāha illā Allāh”; if he also believes that the (Ottoman) State is Muslim, this is even more severe and worse, and this is the doubt regarding the kufr of one who disbelieves in Allāh and commits shirk; and whoever supports them and assists them against the Muslims, in any form of assistance, it is clear apostasy.” - Ad-Durar As-Saniyyah 10/429 But Usāmah Ibn Lādin and the scholars of AQ disagreed. They considered the Ottoman Empire as the “Islamic State”, and that those who fought against them did khurūj (rebelled), and caused division in the Jamā’ah of the Muslims. Likewise this approach of respecting the Najdī school, while acknowledging it is just like any other Islamic movement that has mistakes which should be abandoned as well as good contributions which should be benefited from, was stated by Shaykh Nasr Ibn ‘Alī al-Ānsi, of AQ Arabian Peninsula, when he was asked in an interview: “The question here is: Do you associate yourselves with Wahhabi Salafism, or do you have reservations about the Da’wah of Shaykh Muhammad Ibn ‘Abdil-Wahhāb? What is your view on the writings of the Najdi school?” “We are Muslims fighting in the way of Allāh; we understand Islam and evidence through the understanding of the Pious Predecessors, and we do not confine ourselves to a specific school but seek the evidence. Shaykh al-Islām Muhammad Ibn ‘Abdil-Wahhāb did not call anyone to attribute themselves to him nor to do taqlīd of him; rather, he called people to the Book of Allāh and the Sunnah of His Prophet and to act upon them according to the understanding of the Pious Predecessors, as did all the Imāms of the Najdī Da’wah. The message is also from Hadith Bukhari 25: "Fight the disbelievers until they all convert to Islam and only then will their lives and property be protected…" * In 628 AD, Muhammad moved towards Mecca with an army of 1,400 warriors, a force that was not strong enough to face the mechanical army of the Quraysh tribe. This is why he signed the Hudna Treaty of Hudaybiya, a temporary 10-year ceasefire with the Quraish tribe. An agreement that was considered humiliating for him since he was forbidden to sign it while mentioning his status as a prophet and messenger of Allah. But Muhammad saw this agreement as a victory that gave him time to break the Quraysh's defense agreements with third parties (Bukhari 2731-2732). Which indeed allowed him a year later, in 629, to also attack the Jews of Khaibar. * According to Sharia law, hudna is a temporary ceasefire agreement for ten years; this is the only agreement that Muslims are allowed to sign with the infidels: * TRUCES (Hudna) 09.16 (O: As for truces, the author does not mention them. In Sacred Law truce means a peace treaty with those hostile to Islam, involving a cessation of fighting for a specified period, whether for payment or something else. The scriptural basis for them includes such Koranic verses as: (1) "An acquittal from Allah and His messenger..." (Koran 9:1); (2) "If they incline towards peace, then incline towards it also" (Koran 8:61); as well as the truce which the Prophet (Allah bless him and give him peace) made with Quraysh in the year of Hudaybiya, as related by Bukhari and Muslim. Truces are permissible, not obligatory. The only one who may effect a truce is the Muslim ruler of a region (or his representative) with a segment of the non-Muslims of the region, or the caliph (o25) (or his representative). When made with other than a portion of the non-Muslims, or when made with all of them, or with all in a particular region such as India or Asia Minor, then only the caliph (or his representative) may effect it, for it is a matter of the gravest consequence because it entails the nonperformance of jihad, whether globally or in a given locality, and our interests must be looked after therein, which is why it is best left to the caliph under any circumstances, or to someone he delegates to see to the interests of the various regions. There must be some interest served in making a truce other than mere preservation of the status quo. Allah Most High says, "So do not be fainthearted and call for peace, when it is you who are the uppermost" (Koran ) Interests that justify making a truce are such things as Muslim weakness because of lack of numbers or materiel, or the hope of an enemy becoming Muslim, for the Prophet (Allah bless him and give him peace) made a truce in the year Mecca was liberated with Safwan ibn Umayya for four months in hope that he would become Muslim, and he entered Islam before its time was up. If the Muslims are weak, a truce may be made for ten years if necessary, for the Prophet (Allah bless him and give him peace) made a truce with Quraysh for that long, as is related by Abu Dawud. It is not permissible to stipulate longer than that, save by means of new truces, each of which does not exceed ten years. The rulings of such a truce are inferable from those of the non-Muslim poll tax (def: 011); namely, that when a valid truce has been effected, no harm may be done to non-Muslims until it expires. * In 630 AD, Muhammad's power increased; he broke the agreement with Quraish and moved towards Mecca with about 10 thousand warriors and conquered it. The Quraish tribe converted to Islam, and Muhammad abolished the religious tolerance that existed in Mecca. With his own hands, he began to destroy the 360 holy sites for the different religions that lived there in mutual tolerance and harmony. He abolished this tolerance and left only the Islamic holy site. * Quran 8.58, in fact, allows Muslims to cancel any contract for "fear” that the other party will break it. Not because the other party violated the agreement, but only out of fear. So signing an agreement with Islam is basically meaningless. Quran 8.58: "If you are afraid of the treachery of some of your allies, you may disregard your treaty with them. God does not love the treacherous ones." In conclusion: As a religious command, from Allah, from the Quran, from Muhammad, and from Sharia law: * Islam is in a constant state of war against the infidels, until it destroys them. * When Islam is weak, the believers are commanded to obtain a hudna (temporary ceasefire) so that they can gain strength that will surpass the strength of the infidels. * There is no meaning in signing an agreement with Islam since they are allowed to violate it at any moment. * When the power of the believers exceeds the power of the infidels, the believers are ordered to abandon the Hudna agreement and destroy the infidels.
