There is also a possibility of a hung jury and a mistrial, but if that happens, the vote will be significantly in favor of the defense with only a few prosecution holdouts. My prediction is based on the law in Massachusetts, which requires to prosecution to prove a defendant is criminally responsible (sane) beyond a reasonable doubt. That’s a high burden and different than many states and federal law that put the burden on the defense to prove insanity by a preponderance or clear and convincing evidence.
