Nearly every baby born in America gets a heel prick shortly after birth. The blood is placed on a special card and tested for dozens of serious genetic and metabolic disorders... potentially catching conditions early enough to save a child’s life. What happens to the leftover blood afterward is shocking. In states including California, leftover newborn blood spots can be stored for years. Those tiny spots contain your child's DNA. They can be made available for approved research, and California says researchers may be charged fees associated with providing and processing the samples. But here's the part getting parents' attention: LAW ENFORCEMENT HAS ACCESSED THEM. Records obtained by CBS Sacramento previously revealed at least five search warrants and four court orders involving identified newborn blood spots in California. Investigators also confirmed that a blood spot was used in a cold case investigation. And California isn't the only state where this has become a privacy battle. In New Jersey, litigation revealed police had subpoenaed a child's stored newborn blood sample while investigating the child's father in a cold case. Privacy lawsuits have already forced states to confront what happens to massive collections of newborn blood spots. Michigan agreed to destroy MILLIONS of stored samples following litigation over parental consent. And here's what may shock parents most: Many had no idea these samples were being kept in the first place. California allows parents to request destruction of their child's stored blood spots, but the state's own materials explain there are circumstances where a specimen may not be immediately available for destruction. Should the state EVER be allowed to keep your child’s blood and DNA after the medical testing is over without getting your explicit permission first?
